While vacationing at the ElCid resort in Cozumel my wife and I attended a sales seminar. Our sales associate told us that he was in a hurry because his wife was outside in his car in labor. We were rushed through the signing of our paperwork and we did sign a contract. My wife and I questioned the sales associate at least twice about their cancellation policy which we were told by two different sales associates was 21 days.
We were also given what they stated was market value of our 2 timeshares that we currently owned. This figure proved to be totally false and was almost 3 times what the actual value was. They told us that they would sale our time shares and that if they did not sale within 120 days that our contract would be voided and everything would go back to what we previously owned and that there would be no charges for any of our transactions. We asked both sales associates 3 times to confirm their statements and they repeatedly stated that the contract would be voided and everything returned to it's original state if our timeshares did not sell within 120 days.
We decided to cancel our transaction within the 21 days that we were told we had to cancel. We made several attempts to contact the sales department with concerns that we had. No one would return our calls until we called the company that was handling the resale of our timeshares and told them that we had cancelled our contract. Within hours we were contacted by one of the sales associates that we had repeately tried to contact. He inquired as to why we were cancelling our contract.
He then told us that we could not cancel our contract. We have contacted several individuals within the ElCid Corporation and have reached no resolution. If anyone knows of any legal action that is available, please let us know. Is it possible to file a class action lawsuit?
