Travel Insurance Denied policy because of 120 day prior treatment of non life threatening issues

My wife and I purchased tickets on Cheap Tickets for a wedding. My mother was in a nursing home and was being treated for atrial fibrillation and cerebrovascular disease which are both non-life threatening conditions for which she had been successfully treated for years. She died the week before we were to leave for the wedding and decided not to attend because we just could not celebrate and because we had to take time to wrap up a lifetime of memories and details. We cancelled our flights and contacted Access America to file for the insurance which we thought was a good idea to purchase on all of our flights seeing as you never know what can happen.

We were sent a "physicians statement" document to fill out that had nothing to do with our situation and was told upon asking that this was the only document that they had to file the claim with. We sent this to the physician of record and submitted the form along with a copy of the death certificate which stated that my mother died of Undetermined Natural Causes with other contributing conditions being the aformentioned non-life threatening conditions. Because my mother had been seen by the doctor within 120 days prior for these conditions, Access America determined that these were the causation of her death, even though the official death certificate lists Undetermined Natural Causes. I submit that no matter what condition you have, as long as a physician has seen you within 120 days prior to your cancellation, Access America will deny your claim. This is just not right.

I have had a number of phone conversations with and individual at Access America by the name of Tayvon and he has continually held that he is "legally required" to hold with this position. I have been upside down in reasoning with people who have no interest in being reasonable. I still hold that you can not say that say that these other conditions were the cause of death and Access America says that within 120 days prior, she was treated, therefore they don't have to pay.

Is there anyone out there that has any idea how to deal with this company?

They have totally ripped us off.
