Are Taxpayers & Victimized Children Going to Be Ripped Off By the Criminal Justice System of Travis County, Texas?

I am a taxpayer of travis county, texas and i resent that my taxes are subsidizing this inmate billy dan carroll in jail when he should have had a trial in the manner guaranteed to him by the constitution!

These victims need justice not a backroom deal!

Here is a guy whose multiple offenses of sexually assaulting children and VIDEOTAPING assaults were so horrific that he is STILL in the Travis County Jail because he is considered a light risk and the Court was reluctant to give him bail.

They have him on videotape committing the acts he is accused of committing against children and at least two adult women.

There is one victim on the tape that police have been unable to identify and nobody knows where she is...

(if you know, you are asked to contact austin, texas police or the travis county district attorney's office asap! Your testimony is needed!)

And, according to the Time-Warner Cable TV Station, Channel 8, here in Austin, Texas, a PLEA BARGAIN DEAL iis POSSIBLY being arranged for him so he MAY escape the severity of the consequences of what he did to innumerable children and at least TWO adult women —and he was MARRIED the entire time until his WIFE found out and DIVORCED HIM!

All the time, he was a RESPECTED, WELL-LIKED member of the Austin, Texas BUSINESS COMMUNITY!

The few times an outcry was made —NOBODY BELIEVED THE CHILDREN!

Are these victims going to be ripped off twice— they liked and trusted this man and he ripped them off! And is the travis county criminal justice system going to be allowed to rip of these victims again?

Accused child molester, Carroll could get plea deal

Prosecutors said they plan to make a plea bargain with accused child molester Billy Dan Carroll.

Carroll stands accused of sexually assaulting both children and adults, including a child he was appointed to represent as a court advocate.

Prosecutors said they have talked about proposed punishments with the six families involved. Carroll would be offered a deal in the next couple of weeks.

"When we say that we're going to make a punishment recommendation, I don't want you to think that that means we're going to necessarily plead this case out real cheap, " Assistant District Attorney Allison Wetzel said.

The deal could range anywhere from probation to life in prison for each of the six counts.

A former Austin businessman accused of sexually assaulting several children appeared in court Friday.

A Travis County grand jury previously indicted Billy Dan Carroll on charges of aggravated sexual assault and indecency of a child.

Meanwhile, Carroll's wife is being sued by the parents of a child left in her custody.

They claim Kathy Carroll failed to properly monitor or supervise their daughter while she was at their home.

Billy Dan Carroll is accused of sexually assaulting as many as six children.

On Friday, attorneys filed a motion for discovery to place certain evidence under a protective order and not to be made public.

Carroll's next court appearance is scheduled for October 31.

Billy Carroll's next court appearance is set for Sept. 26.
Travis County will pay the tab for the defense of accused pedophile and former child advocate Billy Carroll.

A judge declared Carroll indigent Friday, and the county will grant him a court-appointed attorney in a defense that could cost over $100,000.

"One minute he had assets and one minute he didn't, " Joe Frederick with the Travis County District Attorney's Office said.

Carroll argued his assets were tied up in his divorce, which was finalized Friday. All his assets were turned over to his wife.

Carroll appeared briefly in court to hear the judge's ruling.
"Everything that they had built together in the last 20 years of their marriage has been awarded to his wife with his agreement, " Carroll's Attorney Bill Hines said.

The former child advocate was indicted on 14 counts of sexual assault, including six children.

Two of Carroll's victims were not happy with settlement, and petitioned to stop the divorce because they planned to sue Carroll in civil court, but the motion was denied.

"This is not the typical case, " Frederick said. "A defendant, who has means one minute, all the sudden gives those means to family members, so that the county can pay for an attorney."

Carroll's attorney, on the other hand, told a different story.

"He's scared and he's is finally looking forward to getting someone to help him with this case, " Hines said.

Hines said he may need to help him find a new venue for the trial, as the media coverage of the case may have ruined chances for finding an impartial jury.

Hines was originally assigned to represent Carroll temporarily, but will now serve as his attorney of record.

Carroll's Attorney Bill Hines said Caroll is scared and just happy to have represenation.

"I'm happy to assist, because certainly Mr. Carroll needs help, " he said.

Carroll's next court appearance is set for Sept. 26 when the judge is expected to set a trial date.

A Travis County grand jury indicted an Austin man for sexually assaulting as many as six children, and videotaping them.

The Austin American-Statesman reported Billy Dan Carroll was indicted late Tuesday for aggravated sexual assault of a child, indecency with a child by contact and indecency with a child by exposure.

Police said a videotape taken from Carroll's home in northwest Austin shows him having sex with children as young as age 2. They said the suspect used a hidden camera to videotape a 13-year-old. Authorities said Carroll also drugged a slushy in order to assault a victim.

A police sergeant said investigators still have one victim they hope to identify from a videotape, but they are uncertain she can be found since they have no way to find her.

Billy Dan Carroll did not bring proper documentation to court Monday.
A former child advocate accused of molesting children appeared in court again Monday.

Billy Dan Carroll continues to petition for a court-appointed attorney because he claims he cannot afford to pay for one on his own.

As was the case last time he appeared in court, he did not have the proper paperwork credit card statements, banking receipts, etc. To prove his indigence, so the hearing was rescheduled for August 8.

He will appear in court again August 8.

At the last hearing, prosecutors told the court Carroll has lived a lavish lifestyle and he has the funds to pay for this defense. Prosecutors said Carroll doesn't want to pay for his defense, and he would prefer the taxpayers of Travis County to pay.

"It doesn't look like he's going to produce those documents, so the next decision is going to be up to the judge in terms of if he still continues to refuse to produce the documents, you know, what her decision is going to be, " Prosecuting Attorney Dayna Blaze said.

Prosecutors said that charges brought against Carroll will likely go before a grand jury in mid-July.

At Carroll's next court appearance, a judge may have a decision as to who will pay for Carroll's defense.

He's in jail on a $2 million bond.

The Austin businessman and former CASA volunteer was arrested last month after an 8-year-old girl reported he sexually assaulted her at his home.

Carroll is being held on $2 million bond.

At his last court appearance, Billy Dan Carroll asked a judge for a court-appointed attorney because he said he couldn't afford one.

He claimed that divorce proceedings had frozen his assets, preventing access to his money.

The judge denied Carroll's request, saying he produced no proof of his claims.

Austin businessman Billy Dan Carroll is charged with six counts of aggravated sexual assault of a child.

A former child advocate accused of molesting children will have to pay for his own defense attorney.

Last week, Billy Dan Carroll asked a judge for a court-appointed attorney because he said couldn't afford one.

Wednesday, a judge told him he must pay for his own defense.

Carroll claimed that a recent divorce and frozen assets are the reasons he can't come up with the money.

But a judge argued that Carroll produced no proof of those claims.

A woman claiming to be a victim of Carroll's was in the courtroom Wednesday. She was relieved at the judges' decision.

Kim Krueger said her mother dated Billy Carroll in the 80s. Then a child advocate and well-liked by most, Krueger said no one believed her stories of Carroll's sexual abuse.

Carroll lost his bid for a court-appointed attorney.

"He would make your family believe that he wanted nothing but your best interest, but then when he had you alone it was different story, " she said.

Carroll's story Wednesday didn't have the end he hoped for.

"I don't think he wants to pay for an attorney, I think he wants the taxpayers of Travis County to pay for his defense, " prosecutor Dayna Blazey said.

Prosecutors told the judge that Carroll lived a lavish lifestyle and has a home that is worth close to $400,000 as well as $70,000 in business assets that he has made no attempts to secure.

Blazey said numbers are the easy part of this case.

It is heart rendering to hear from the victims; it's very touching, it's a very, very sad case, " she said.

Krueger said it's just as difficult for her 27 years later.

"The more I read and the more I hear, the more I remember [...] it just sickens me to my very core, " she said.

Wednesday, a judge told Carroll he must pay for his own defense.
A statute of limitations will keep Krueger's case from being tried, but she said she will testify in the sentencing phase. She will be speaking for her own healing, for other victims and for future victims she wants to prevent.

Prosecutors said they expect Carroll to challenge the judge's decision.

Carroll is charged with six counts of aggravated sexual assault of a child.

The Austin businessman was arrested last month after an 8-year-old girl reported he sexually assaulted her at his home.

Carroll is being held on $2 million bond.

He is due back in court again on June 23.

A former child advocate accused of molesting several children wants a court appointed lawyer.

Billy Dan Carroll appeared in court Friday morning, and told the judge he doesn't have the means to afford an attorney.

He said his former business partner has frozen his assets and his wife filed for divorce this week.

The judge ordered Carroll to turn over his tax, bank and credit card records.

Carroll's next hearing is scheduled for Wednesday.

Carroll is suspected of assaulting at least eight children ranging in age from two to 16 years old and two adults.

Austin police filed a new charge of aggravated assault of a child in the case involving Billy Dan Carroll, when a 16-year-old female said he sexually assaulted her in 1999.

On Tuesday the Austin Police Department's Child Abuse Unit interviewed a 16-year-old victim in regards to an improper video allegation involving Carroll.

According to police that brings the total number of identified victims to ten: eight children between the ages of 2 and 16 and two adults.

The 16-year-old girl told detectives she was spending the night at Carroll's home when the incident happened.

News 8's Reagan Hackleman files the following report about the newest charge in the Billy Carroll case.

Last week, Carroll was charged with sexually assaulting children, including one as young as 2, and was charged with operating an illegal hidden camera in the bathroom of his home in which he taped a 13-year-old girl.

When police searched Carroll's house they came across such video evidence, showing Carroll sexually assaulting other victims, and most all appeared unconscious.

Police said Carroll got close to the girls because of the kind of person he pretended to be.

He just has this ability to make people like him, Sgt. Brian Loyd of the Austin Police Department said. He's made all these families like him, they trust him, they like him, they allow their children to spend the night at his house because they trust he and his family and unfortunately he violated their trust.

Police said in many cases Carroll would give his victims a red slushy drink to make them pass out.

The oldest case dates back to 1981.

Charges of aggravated sexual assault of a child is a first degree felony.

Police say it's the worst child abuse case they've seen in Austin.
More charges were brought against businessman Billy Dan Carroll on Friday.

Police charged an Austin businessman with four new counts of sexually assaulting children, including one as young as 3, and with operating an illegal hidden camera in the bathroom of his home with which he taped a 13-year-old girl.

Police said all of the children are female and were found on a videotape confiscated from his home. Two of them were sisters.

They said two adult women were sexually assaulted on the video. Both were also unconscious and didn't know they were violated until police contacted them.

Police said this is the worst child abuse case they've seen in Austin. "He's a pedophile and he preyed on children not specific to age. It's whomever he could groom into the position that he wants them to be in to get them to volunteer for the acts, " Sgt. Brian Loyd with the Austin Police Department said.

Police said there's no telling how many victims are still out there and they are asking for people with information to come forward.

Police have released new information in the Billy Dan Carroll case and said they've identified more sexual assault victims of Carroll.

Carroll, 53, is being held on a $2 million bond in connection with the aggravated sexual assault of a child.

Police said they may have positively identified more victims based on a videotape that was confiscated from his home last week.

The videotape shows Carroll involved in sexual acts with multiple children and two women who appear to be unconscious.

Also, police said they know why the 8-year-old victim and her three siblings were at Carroll's home in the first place.

CASA response:

A representative says Carroll had "glowing personal references."

According to police, the two girls and one boy who were also at Carroll's house were the adoptive siblings of the victim. Carroll was a court appointed advocate through the Court Appointed Special Advocates (CASA) organization. The children were court appointed, with Carroll assigned as the advocate.

The victim was not involved in the program, according to police. CASA maintains that this case had been closed. CASA also said they recommend volunteers do not maintain contact once their job is done.

The way people describe Billy Carroll is far from what you'd expect of a serial rapist, as police have called him.

Laura Wolf with CASA of Travis County said his references said only stellar things about him.

"We got, as I said, glowing personal references from people who have known him for years and said things like 'he's the person I would want to take care of my children if something happened to me.' These are people who have known him for 30,40 years, " she said.

Sgt. Brian Loyd with Austin police said you just never know though.

"The good ole boy everybody trusts and the best neighbor in the world, " he said.

According to police, Carroll had grown close to this particular family and was trusted like a relative.

Carroll invited the kids to spend the weekend with his family, but the children's mother was under the impression Carroll's wife and high school-age daughter would be home, police said.

The kids had spent the night at Carroll's house before, and police said no one could have guessed what allegedly happened.

Even if you do background searches all day long, you may never know until something like this happens, Austin Police Department's Sgt. Brian Lloyd said. Until some child or individual comes forward and goes, Hey this happened to me.'

As soon as CASA learned of these allegations, they dismissed Carroll as a volunteer. He was assigned to a case at that time and had been a volunteer with the program since 2004.

CASA is working closely with the police department during this investigation.

Police said they have received several more leads in the past few days, and they're investigating all of those. They say they fear Carroll may have been a sexual predator for years.

Billy Dan Carroll, 53, is being held on a $2 million bond in connection with the aggravated sexual assault of a child.

Police said they were called to his house in northwest Austin on Sunday, May 18.

An 8-year-old girl told police that Carroll sexually assaulted her at his home while she was spending the night at his house.

Carroll was arrested and charged with aggravated sexual assault of a child which is a first degree felony.

'Worst case'

One Austin police officer says the child abuse case is the worst he's seen in 22 years.

Police said he met the 8-year-old girl through his volunteer work with at-risk children at Court Appointed Special Advocates (CASA).

A CASA representative said the organization went through the same background checks and screening procedures with Carroll as with all volunteers and until news of his arrest had "no cause for concern."

One Austin police officer said the child abuse case against the local businessman is the worst he's seen in 22 years.

"The graphic depictions that I've seen through the video and different children, um, I've not seen anything like that, Austin Police Sgt. Brian Loyd said. This is going to be one for the books for us."

Police said they believe there are additional victims and they need the public's help to locate them. Police said they believe there are five other children and two adults involved in this abuse case.

Police said six of Carroll's victims range in age from 3-15 years of age.

Carroll is a co-founder of Fredericks-Carroll Reporting and Litigation Services, Inc., a court reporting and litigation support firm in Austin.

Company co-founder, Bill Fredericks released the following statement:

"It goes without saying that those of us at Fredericks-Carroll are shocked and saddened by the news. Our company was certainly not aware of any of the allegations underlying Mr. Carroll's arrest and we condemn any criminal behavior that may have occurred, particularly in light of the fact that the allegation involves a child."

Police said the bond is set much higher than most cases of the same nature as Carroll is an affluent man and could potentially try to leave the country.

If convicted, he could face 5-99 years in prison.
