I sold a New lawn mower motor on Ebay. The buyer refused insurance so I purchased insurance. I shipped the motor to him in a contructed 20 lb crate, totally enclosed. He received the motor and said it would not fit his mower (his error) and asked if I would take it back. I told him No, sell it on Ebay. The next day he called and told me it was damaged when he recieved it. He said his buddy was the UPS driver and he would help him out. He asked if I would file an insurance claim. WHAT NERVE!!! But, I did.
He shipped the engine back to me at no cost to him. When it arrived, it was completely open. The crate had no sides. He did not fasten the motor down. The motor had major damage. I got an email from Paypal notifying me he had filed a claim and wanted a full refund. I told him when the insurance settled. Paypal decided in his favor and made me refund him. I appealed. They denied the appeal.
If I had reported him to UPS for suspected fraud, I would have gotten nothing. If I had not purchased insurance, I would have nothing. The problem is, the motor is going to cost more to fix than he paid for it! In other words, I have a piece of junk. I am stuck with all the losses. I am the one who did everyhting by the book. This guy has lost nothing. He wouldn't even reimburse me for the $30.00 in additional shipping and insurance fees.
I called Paypal and the rep said there was no way he would win the appeal since he had not followed the guidelines set forth by Paypal requiring that the parcel be returned to the seller in the same manner it was received by the buyer. I will never use Paypal again.
I just want to know if I have any recourse in this matter?
