I was an employee of Fischer Brothers Trucing until Feb. 17 one day after having major surgery. While I was in ICU I was fired acording to their paperwork. Feb, 17 was on a Sunday. Their office is not open on sunday, but acording to the paperwork that was my termination day. That was also the day the insurance was canceled by Fischer Brothers.
I found out April1.2008 that I had no insurance when I went to fill a prescription at the local Walgreens. I had not been notified nor was I offered COBRA until after my insurance was canceled. When I called the insuranc company they told me to get in touch with Fischer Trucking, who had told me more that 6 times that I stll had a job, and as soon as the Doctor released me to notify them.
I called them late in March to let them know that I was in my last 2 weeks of physical therepy, and wanted to return to work at the end of that 2 weeks. I was told to contact the Safety Director, when I did, he told me I would have to take another physical and there would be no problem if I passed the physical and the Doctord released me. Then 2 weeks later I was told that I had been terminated. What they did with the insurance thing is against a federal law called the Arisa Law, My attorney will handle that, and the4 wrongful dismissal charges that we will bring.
