Corporation Pella referred contractor voided our warranty, by incorrect installation-Pella standing behind installer

I will write to you, what I have written to both the Nevada Board of Contractors, and Pella windows and doors:

Unfortunately, the instattation of our windows involves not only the contractors board, because of the way the windows were installed, but also the consumers affairs division, for Pella referring for referring us to the contractor, Pella's inconsistency in both firing of the contractor, and indorsing the contractor at the same time, Pella's terms and conditions of sale agreement, indicating we no longer have a warranty, and Pella's web site stating we do have a warranty because of improper installation. Since Pella's has shown so many inconsistencies, and the contractor has shown no regrets or accountability regarding this whole situation, I feel Pella should not have the last say-so regarding this situation, just because you received the last "dated" letter from them, stating we have a warranty.

Unfortunately, Pella Windows is being fraudulent in four areas. They are putting the cart in front of the horse.

The first item I feel Pella needs to respond to is as follows: Pella stating we still have a warranty when it comes to "product related concerns". Please take a special notices to the initial purchasing "terms and conditions of sale" agreement that is presented to the customer, before any product is purchased, both Pella sales and the consumer are required to sign their agreement which specifically states: "important notice regarding installation of pella products and proper management of moisture with in the wall system", and Pella will not be held responsible for any warranties which are inconsistent" and "voids out all warranties".

The second item I feel Pella is fraudulent on, and needs to respond to is as follows: Pella indicating in the memo dated May 7 that "they have not come across any warranty related issues as a result of the installatiion, therefore have no reasons to believe that the warranty has been voided due to improper installation". I would like to know how they can get away with stating this, based on their "purchase agreement" and the way our windows were installed, i.E.-no flashings, allowing moisture with in the wall system. This report has been received by Carol Bailey, a customer service department supervisor located in Pella, IW.

The third item I feel Pella is being fraudulent on is a letter dated May 27, where Brian Buch from Pella, which again Pella is talking about installation and warranty issues which is inconsistent with their "terms and conditions of sale", and where they talk about the contractor, which they referred to us as "having a long history of providing quality installation of Pella windows and door". Well, I know as fact, that Pella, nor the family that had their windows installed before us, who use the same contractor, knows if their windows were installed correctly or not. The only way to know for sure is to have the window trim removed. Which we did, while the windows were less than one year old. The question is why would the contractor have installed them any differently. If I had to guess, I would say he also installed them incorrectly. The letter I am indicating at this time, from Pella, highly indorsing the contractor for their "long history of providing quality installaton". The truth is the contractor is no longer a part of Pella list of contractors, because he was fired from them. This was verified by a Reno Pella installer who came out to our home on October 16, to make a assment of the damage he saw at the time, and who indicated the one and only Carson City installer that Pella, Reno had, was no longer working for Pella. This statement remains true today, June 3, because I called the Reno office and asked them if they have any Carson City contractor, and they said no, the closest one is located in Reno, NV. This statement leaves me with the impression that the contractor who installed our windows, and that now Pella windows so highly endorses, they actually fired before October!

The fourth item Pella needs to address is the e-mail dated May 14, received from Pella's Randy Sedlock, a correspondence specialist stating exactly what Pella's "terms and conditions" of sales covers. Basically, we do not have a warranty, if our windows are installed without flashings, which they were! Why is Pella corporation not addressing this e-mail I received!

My point at this time will be even though Pella has mailed off a letter dating May 27 stating all of the preceding informatio, their letter should not be held as the last statement regarding this situation, since they seem to be inconsistent with their warranty issues. Why is Pella Windows and the contractor not being held responsible for installing new windows and doors and installing them per pella warranties?

Please have Pella address all the issues above.
