Ripoff with deceptive cancellation period is consumer rip off

My parents got ripped off buying a Kirby for themselves and another as a gift!

On Friday, October 18, at 10:30pm I received a call from a Douglas Emerson, saying he was a friend of my parents. Well, as it turned out it was a follow-up sales call to see if I received my Kirby Vacuum, a gift from my parents. Douglas is the owner of Easertn Pacific Marketing/Dilllingham Kirby on Honolulu, Hawaii. Being that no one was home, I didn't receive the delivery. I received the entire delivery by Monday October 21.

Upon receipt I called my parents to ask them to get the vacuum returned and to get their 1,500-I don't need it. (I found out that they also bought one for themselves and their not even using it. Their house isn't even carpeted! Only an oriental rug!) I urged them to do it right away, especially since there was probably a time limit.

I went ahead and called Douglas and left a message with the receptionist about the situation. I received a call back and Douglas said that they couldn't take back the vacuum because now the finace company "owns" it. He stated that my parents had "lots of time to cancel the contract", they had three days to cancel the contract from the date of transaction.

However, how are they supposed to know that I didn't need it within 3 days, when I didn't even receive the vacuum within those three days? In fact, the date of transaction on my receipt slip is dated October 9. I received the phone call and the Shipment Notice on October 18, already 9 days past the transaction. I physically did not have the product in my hands until October 21.infact, the FedEX 2 Day Delivery (notice the irony there!) Airbill shows the vacuum leaving their premisis on October 16th... 5 days AFTER the date of transaction. It came here to California in two days.

Now correct me if I am wrong. This time frame does not premit one to review the product and return it within the 3 day limit. My parents were unaware about there being no refund/exchange if the recepient of the gift did not need/want it.

According to Douglas, everyone involved, my parents and I, are stuck with a product that is not needed, wanted or being/going to be used, and that is the end of the story. They can't or won't take the product back, or offer any restitution.

I beleive this is wrong. This preys on my poor old parents meaning to do well. As much as I appreciate their gesture and thoughts on the gift. I am afraid they have been scammed when they bought 2 Kirby vacuums at once. The have to pay 1,500 for each vacuum plus a $900, finance charge, at the end of the 3 year plan, which is at a 18% APR.

As of this date, my parents haven't even touched their Kirby. It still stands unused, save for the demonstration the Kirby people put on. I would be happy if I could at least get the Kirby I received returned... As soon as I got it, I called the company to get it returned, not even 3 days after I received it.

As far as having a Kirby sent as a gift, I think the company should allow more time for a return. This is outrageous!
