My mother deeded property to my daughter to build a home. The property was suppose to be the back portion of the land. Jim Walter said they wanted the front property and had their lawyers to draw a deed indicating that the front property was for my daughter. My mom told them to change the deed, they did not. We did not know that they were building until we happen to go by and the foundation was laid.
There was no notification at all of anyone about to build one the land. When they first surveyed the land, the stakes were in the correct place. But when the building started, according to the surveyor, the house is forty feet on my mother's property. Somehow they doctored up the deed and it look as if my mom gave the front to my daughter, but she did not.
I was there when she specifically told them that the front part of that land was her and they were suppose to redo the deed. There was no lawyer involved in these transactions except those for Jim Walter, they indicated to my daughter that she did not need a lawyer. Now they are foreclosing on my daughter's house that was built on my mother's land. They built the home in the middle of the property so that both parcels of land would be owned by the buyer.
We have contacted every lawyer to try to take the case and they said it would be hard to win. My mom is 75 years and have suffered a heart attack, at the time she deeded that property to my daughter, she was just recuperating from her heart surgery. We are now about to be out of a home and land. My daughter and my mother have been taken advantage of by these people and there is nothing we can do.
I told her not to let them build, but she was 24 at the time and did not know any better. She was naive of any legal matters concerning this transaction, now her and my two granddaughters are out of a home and my mom is out of her land. Something needs to be done.
