I purchased a dodge neon 2001 Feb. Of this year. I have never been late or asked for an extension until Oct. 15. I called BSK later on that day to make a normal payment and not except the extension which would be Tuesday, Oct. 18 (today).
When I called Bsk on Saturday, Oct. 15 at 4:30pm, I spoke with the secretary and I asked her what time do you all close? She said, "We close at 5:00p." I then asked her if they would remain there until I could bring in my payment (I must take each payment to the company and I live approx. 26 miles from them there and back) she said, "We can't stay here and wait for you but I have some work to do (as if to say if you're not here before I finish my work then you will miss me).
I said, "That's sad that you all can't remain open for your money." I hung up the phone and decided to make an extended payment of $135.00 because I did not want to travel that long distance to discover she finished her work before I could get there.
On Tuesday, Oct. 18, I found out that BSK owner Jimmy also my car salesman, had placed me on a repossession list because I did not come in on Sat. (after finding out he was right there listening to our conversation and remained there until 6pm). We got into an altercation over the phone because I was upset that he placed me on a repossession list for no legitimate reason.
I told him to come get the car because he said after I asked him if he wanted the payment or the car? He said I want my car. I later called him back and said I'm not giving up my car because I have my payment. He said I've already told the tow truck to come for the car and it cost me money to send them out. I told him to take me to court for the car and hung the phone up in my face. What are my rights in this matter? Have I done the right thing? I'm hiding my car until he takes me to court.
