Consumer Mortgage Company
Deceptive Practices

In July I visited a Joe Myers dealership responding to an ad for bad car financing. I was told I was approved and that the finance company was requesting a $500.00 down payment. I gave Joe Myers $500.00 in cash and a check to hold for the remaining. I was told I would have to go to the finance company's location to complete the paperwork. When I went to Consumer Mortgage Company's location and discussed the terms of my loan I decided that it was not in my best interest to go thru with the deal. I was informed that I had no grace period and that the car could be repossessed if it were one day late. I was told there were no extensions or skip payments. I called Joe Myers Ford and expressed my concerns to my salesman and he informed that I could not get my money back and that based on my credit I would not be able to get financed elsewhere. I went thru with the deal and everything was going fine until I got laid off from my job. I called Consumer Mortgage Company asking for an extension and was denied. I struggled to make my payments to avoid repossession and defaulted on a lot of my other bills. I also had trouble making my auto insurance payments because I could not afford it at times. I had to make a choice my auto insurance or my car and I chose my car.in March the car broke down and I had to pay $466.00 for repairs. I was almost three weeks late on my car payment (the latest I had ever been) and the collections department contacted my father and informed him that they were going to repo my car. My father contacted me right away and I called and spoke with James Hayes. I explained to him what happened and he told me it did not matter I needed to turn the car in. He would not work with me. He said the car would look better on me if I turned it in voluntary when I went to get another car. That was very hurtful because when I was unemployed I made my payments and was a good customer despite my credit. Nonetheless, I contacted the company again to determine if there was anything that could be done and once again I had to speak with James Hayes. Mr. Hayes was very rude he told me that he couldn't help me because I had already been given an extension. I asked how was that possible because I was told the company does not give extensions and denied. He stated because of the lapse in insurance in the vehicle he had given me an extension to keep from repossessing the vehicle. I informed Mr. Hayes I was not behind on my payments and had not been notified of an extension. He stated the company did not have to tell me anything and that because they brought insurance and added it to the loan I delinquent and he had given me an extension. He told me to turn the car in. I informed Mr. Hayes that I felt as though they were trying to force me into to repossession he told me to get an attorney and hung the phone up. Nonetheless, I was able to make my car payment. I requested my payment history and found that I was given an extension and called in to speak to someone regarding the matter and no one seemed to care. Now the engine is blown in the car and I contacted the company again to try to work out something and they will not help me. My credit is not so good and I have been unsuccessful in my attempts to get refinanced elsewhere. I don't think it is right what this company has done to me. I have been a good customer no matter what obstacles I was facing.
