My brother is serving in the United States Army. He enlisted because he had a daughter at a young age with a young lady by the name of Sarah Jane Howe. Neither one of them were doing anything productive with their life and he felt that his life was going downhill because of his involvement with this young lady.
He wanted a better life for his child, so he enlisted in the Army. The main problem is that the mother of his child was in love with him but because she had caused him to get into trouble with the law on atleast 2 occasions and because their child was burned under suspicious circumstances in her home, (I say suspicious because she refused to take the child to the doctor and the burn was a second degree burn. She kept it hidden.)
He didn't want anything to do with her anymore. He married another young lady and they have two children together. Sarah Jane Howe has done the most despicable, dishonest and hurtful things to my brother since she found out that he was with his current wife. Hell hath no fury like a woman scorned.
She got a restraining order against him while he was training to go to Iraq and had it sent certified mail. He has never hurt his child, so I haven't the slightest clue how she could get this order in Indiana. There was an existing order for visitation issued by Judge Riley in Bridgeview Circuit Court in Illinois, but the Indiana Lake County restraining order overrides that.
I have general power of attorney for my brother. He obviously will not get leave so that he can defend himself against this restraining order that is full of false allegations. It is really heartbreaking that any human being could do this.
My brother loves his first child to death. He cries over having not seen her in almost a year. Now he probably won't be able to see her before he goes to Iraq because even though the military power of attorney permits me to ask the judge to enforce visitation on my brothers behalf, Judge Daniel Riley refused to even look at the Military Power of Attorney at my court appearance, March 3.
A lot of our soldiers are dieing in Iraq. Having served eight years in the Marine Corps, I can't begin to fathom how my brother is able to cope. I couldn't imagine having to deal with the stress of having friends die and realizing that it could be you and not even getting the chance to see your child before you go.
Judge Riley was aware that my brother was leaving for Iraq. He was aware that Sarah Jane Howe of 1517 N. Arbogast in Griffith Indiana is in violation of an order allowing my brother visitation simply because she is upset that he chose someone over her. Yet, he refused to use his power as a judge for good. He didn't even consider doing the right thing.
There is so much more to this sad story, but I am leaving this matter in God's hands because the devil is working against my brother and his child who is the victim in all of this. I can't even set up child support for her benefit which I also have the power to do now that I have power of attorney.
Judge Riley's decision has hurt my brother's child not only by not giving her the opportunity to have a relationship with her father, but also by having her live in poverty by not reading the power of attorney and allowing me to set up a direct deposit for her benefit.
I would like to think that this wasn't his intention, but my brother is now suffering none the less. My brother can't afford an attorney on an E-2 salary with a wife and three children. A pro bono attorney would help, but your prayers are what he really needs. Please pray that God will give him strength to deal with all that has happened and still serve our country.
