I saw ad on Rachel Ray show for a free trial of Lypothin and Active Cleanse. It never said future charges would occur unless I cancelled or cost.
The TV ad directed me to the web site for a free trial offer. I agree to pay the $3.95 shipping cost for Lypothin and $5.95 for Active Cleanse. No mention was made that I was signing up for future deliveries of the product or that the entire cost of the product would be charged if I did not cancel within 14 days. What it did say was "if the system is not for you, call our customer care line at 1-888-606-9353 within your 14 day Risk-Free trial period to cancel. You will then be issued an RMA number to return the product, and you will not be billed any additional amount or receive future shipments." I supposed that some attorney has approved this language as having warned consumers in some vague way that this is an auto-ship program and they and their credit card are hooked if you don't call within 14 days. No price was ever quoted for the product if you didn't cancel within the 14 days. But I have never agreed to buy a product without being given the price first, much less agree to automatic shipments and multiple credit card charges within the same month. The original order was placed on April 22 and the fraud department of my credit card company called my husband to report the above agreed upon shipping charges for the free trial because the charges originated from a store front in Ireland. After calling me to see if I had authorized the above charges, he told them to go ahead and honor the two transactions in the amounts shown above. The product was shipped and I received my free trial of Lypothin and Active Cleanse, not realizing that any more money would be charged for this shipment. The attached paperwork did not quote any cost and so I assumed that the free trial was simply, that, to introduce me to a product that if I liked it, they were hoping that I would order more. At that time I expected to be able to evaluate the cost of the item before shipment
On receipt of our credit card statement, we were shocked to see charges on May 10th for $89.41 Lypothin Now and $82.61 Active Cleanse. We felt violated because this price had never been quoted and I never would have agreed to pay such a price for an unknown substance not perscribed by a doctor. This charge was never agreed to and should have been blocked by my card company but I guess because of the earlier small charges from this same vendor that were approved by us, they let it go through. On the same day that I received the credit card bill in the mailbox, my husband again got a call from the fraud department of the credit card company, Nationwide Bank, and he told them that the charges they were calling аbout: $88.56 for Lypothin Now and $95.36 for Active Cleanse that were attempted on May 28, were not authorized and should not be honored. He called back to the fraud department the next day after learning of the May 10 charges asking them to remove those charges too but they said since we had ordered the product over the internet and it stated that the free trial had to be cancelled within 14 days (even though it never quoted the price or stated clearly that we were now on an auto ship program) that we were on our own with those initial May 10th charges and would have to seek our money back from the company that shipped the product. A few days later we received a second shipment of the products. I called to cancel any future shipments and after several days of phone calls, finally was able to obtain the required RMA codes to return both products. We returned both product shipments by receipt tracked mail and are waiting to see if the May 10th charges will be refunded. At this time we are not clear whether our credit card company has stopped the May 28th charges or if we are being charged for that second shipment as well. Even if the company refunds all our money, we feel violated by the deceptive "free trial" practices and lack of disclosure. This should be stopped!
