I engaged in a modification agreement for my home loan, on March.

The documents were signed, putting me on a trial basis of 3 months, as required by FHA. My first payment was due May 1st. The documents had to be sent back right away.

I sent the documents on 3 and the first payment via Fedex on April 25th.

On May 15th I received a noticed from Bank of America attorneys Shapiro, Fishman and Gache, LLP in Boca informing us that on May 15th at 8:30A.M. There will a motion to Cancel Foreclosure Sale in front of the Presiding Judge of the Foreclosure Master Calendar Court at Dade Count Courthouse.

To start with the documentation, signed May 13th was received by me at around 4:00 P.M. On the day of the hearing, second it did not prompt a reaction from me becase it was a process that was supposed to happened being that it was supposed to happened because of the Modification process.

On May 16th I received communication from an advertising firm advising me that my house of 27 years had been sold on May 15th at 10:45 A.M.By Bank of America for $160,100.00.

This started a hard to determine amount of phone calls to Bank America, Ms. Jacqueline Montague who could not explain what had happened and promissed to get back to us no later than Wednesday, May 22nd.

When I followed up on said date we had been assigned a new Account Manager, Mr. Carl Korczykowski who advised us that they had requested a rescindig order and that he would get back to us on Tuesday, May 28th.

I contacted him yesterday, and although he indicated that the sale should not have happened because the account is clearly marked "under modification trial" he has not been able to get anyone within BoA to approve the rescinding order. To top it all, today is 10 days from the day of sale, and we are widely exposed to receiving an eviction order. We are also due to send the second payment of the modification trial but BoA would not accept the payment because the accout is earmarked as the property havinv been sold.

Please help me Howard, we don't know what to do anymore. Our loan number is (Personal Information Removed)
