I waited 3 months for a loan modification approval from bank of America, my mortgage was 4 months behind and the house was in foreclosure process and there was an auction date on the house for April 5TH after waiting without an answer from our mortgage bank and 5 days before the auction we decided to call hope for help they were able to get a loan modification for us (or we thought) the day before the auction date (April 5Th) a negotiator from bank of America called me and ask me to send $1600 dollars ONLY FOR THE PURPOSE OF STOPPING the auction on the house. He asked me to send the money that same day by western union via quick collect and that he would check later on that day or the day after in the morning to see if the money was there. We had a real hard time putting the money together and with a lot of effort we finally did and immediately send the money. Then by April 9Th somebody from Fannie Mae was trying to put a lock on the door (they couldn't because we were at the house) we immediately called bank of America and they told us that the money was supposed to get there on the 5Th no later than 3:00 pm and that's why the house was sold to Fannie Mae (this guy never mention to send it before an specific hour.) after several attempts to talk directly with him I finally got to talk to him and he ask to send a copy of the western union receipt to a fax number he gave me and he said he was going to start a process of RESENDING which means buying the house back from Fannie Mae. It's been a month and a half and every time we called we cant never EVER talk to this guy and we talk to at least 30 negotiators in the past month, they all tell us the same thing "it's in resending process, and that's all they know (no body knows anything) we can send him an emergency e-mail asking him to call you" in the mean time we keep receiving letters from Fannie Mae lawyers asking us to reply before may 13 by going to court we called bank of America so we could get proof that they were working in the resending process so we could take to court. That day we contact the attorneys that are working on the eviction to ask if they have received any notice on this case from bank of America and they said no but they got in touch with Fannie Mae to find out of any notices from bank of America regarding our house and for our surprise Fannie Mae told them that they are not working on any resending of this property with bank of America of course we call them back & told them what we find out about Fannie Mae and they actually admitted that the y could see that the property was not in resending and supposedly they are going to send a request to the REO. How can we keep on believing in this bank? We know that Bank of America has hindering this case for the intent to foreclose our house. Bank of America it's been misleading us with false and wrong information since the begining and never went through with our loan modification. Now we have a court date on may 25th for our eviction.
