Here's my story to the fray (I was thinking about submitting this to BBB, but wasn't sure to which ones I should be directing it to):

I got a Sony GRZ660 laptop from my mom in the summer of and have sent it for repairs to GE Zurich twice through Circuit City under an extended 4-year warranty (exp. 2007).

The initial problem with the laptop was that it wasn't turning on. After sending out for repairs, I got the laptop back only to find that the problem was still there and hadn't been fixed. And, although I'd sent the item intact, I received it with a "foot" (a small hinge that props up the computer) missing, apparently broken off. I also received a claim notice from GE Zurich indicating that it would not be repaired under warranty because of "physical damage."

During the second time the computer was sent, I was a little more careful in checking the computer for any additional physical damage before sending it in for additional repairs (besides minor dust, there was none). This time after receiving the item, I turned the laptop on in the store to make sure it worked.

However, after getting home, I noticed a hole that had been punched in the corner of the computer. Additionally, as the computer's motherboard and BIOS had been changed, there are a number of functions and programs that are now irrecoverable.

I've attempted to take this to Circuit City again for repairs, but the store manager now claims that laptop repairs should not be sent out from the store, and that they are handled exclusively by GE Zurich. But after talking with GE Zurich, they have claimed that they are not liable for servicing the computer because I had received it as a gift, and although I've sent the item twice for repairs, the no-lemon policy doesn't apply.

Couple questions:

Has anyone filed in a small claims court, and what was the result? Did you get your full money back/what happened? The possibility of a class action lawsuit seems to be getting smaller, as all the websites/groups are being systematically taken down.
