There is a fraudulent, misleading seller on Ebay who has ripped me off and is ripping other unsuspecting shoppers.

This seller often doesn't reveal whether or not an item is really working, it may be an item for 10 dollars, or 75 dollars, but this seller will describe the item as in "New condition, powers up, display model, as is".

Then after the customer gets their item home, they many times discover that what they just purchased doesn't even work!

And Ebay lets this seller get away with misleading people just because the seller includes "As Is" in their description!

But when someone says an item is in "New Condition", isn't it true that most people would believe that new condtion, means new and working?

In my case I was shopping for a new home phone. Saw that Ebizzbestbuy on Ebay had a phone set that had an answering machine w/corded phone, and a separate unit for a cordless phone.

I bid on it and ended up paying just for the phone $10, then shipping cost. (even though this is a rather inexpensive item, the issue is how this seller sells broken items under misleading advertising and how this seller treats people after the sale of such items)

This phone was supposed to come with a manual, and I wouldn't have purchased one that didn't. When I receive the phone, no manual is included, so I email this seller about the manual and get no response.

Then I find out that the answering machine doesn't work, and neither does the cordless phone even after buying a new battery for it!

Since I didn't receive any prior response to my inquiry about the missing manual, I went ahead and posted negative feedback and received the same in reply in which the seller informed me that for the cost of shipping they would ship me another phone...

I feel it is unfair that I should have to incur any additional cost when not only did this seller send me a completely useless item, but also sent it in an incomplete state since the manual was missing.

I asked this seller why can't they just give me my $10 cost for the phone back because it will cost them $10 in loss just for the replacement phone they would send me, even if I did pay for shipping cost!

Again, I get no response to this question!

If you look at some of the most recent negative feedback it will tell you of the same thing happening over and over, such as:

"Product broken, auction description misleading, contact with seller useless."

"A real crook! Sends you a product that doesn't work & will not contact you!"

"Sold New! Got poorly packaged, damaged mold-corroded dehumidifier! They blamed Fed-Ex!"

"Doesn't answer e-mails, had to call, VCR came broken, bought on 6/30/03, on 7/27/03 still no answer".

Ebay does have a free mediation service that works between both parties to resolve differences and discrepancies.

Someone I know that got ripped off by Ebizzbest buy also tried the mediation service, but Ebizzbest buy chose to ignore the whole process and never even bothered to respond!

This seller misleads people by describing the items as "a good addition to your home (or office)", "new conditon", "appears to be a display model", etc. And then after the catchy description are the two that seem to let them off the hook "as is"...

How many people do you know go shopping online to buy something broken?

Is it an honest business practice to mislead people with descriptions such as "new condition" while at the same time choosing not to test, or to reveal the true functionality of the item, and then after the buyer receives it, it is broken and useless?
