A case of it all being in the name... Proxy COnn

My husband purchased a Proxyconn acct. 6 mos. Ago. Proxyconn, against their own terms, accessed my bank acct. For a second payment. I have contacted Proxyconn to make an official dispute, Proxyconn repeats, "no refund" even though we wish to cancel and not renew for 6mos. And my husband is no longer an active customer.

We have asked for their physical address and the original terms that were agreed to - We have received neither. We had to hunt down the company info on our own. I replied to an email from last nite repeating that my questions are not being answered and I have not received any further responses.

Proxyconn's haphazard and ever-changing fine print terms on their website still make it appear as if one is only authorizing for the FIRST payment and that you will have a right to terminate at the end of the initial payment period. These complete terms do not pop up when you purchase. Also, their site states that you can cancel and have it end on that month thus getting a prorated type of refund. All I keep getting is that we can use the acct. For 6 more mos. We don't want to use the acct. The acct. Has been inactive for quite some time now and stands cancelled. Proxyconn forces a reinstall and use of acct. To cancel as well - all of which I assume is to say that you are a current user.

Proxyconn's site states that Proxyconn wishes to come to settlement of disputes in a friendly matter. However, the dodging of requests for information and tossing up of altered or no longer existing terms, and now zero response is not friendly.

Some of Proxyconn's website terms are listed below. Keep in mind I have been informed the type of acct. We have is no longer an option and that is why no terms or references are made to it on the site. However, the term "or as arranged" in acct. Reference is all over. Apparently that is why I am not sent a copy of those original terms? I wonder how many of the initial customers are in this category of Proxy implied nonexistance!

Note they do reserve the right to alter as they wish - it is in their terms. However, none of these terms should apply to me if this is not my "type" of acct. And Proxyconn stated their is no reference to terms in re my acct. Type? Go figure.

Note the auto renewal listed right under your right to terminate. If they auto renew without notification, how can you be aware and terminate? The only way you will find out, is if it suddenly appears on your financial statement! I feel no matter if we would have chose to terminate prior to the ending of our 6 mos. Term - no matter if these posted terms were for our "type" of acct. Or not - Proxyconn would have changed the terms to meet their thieving needs. I suspect the right to alter after purchase is illegal. Just because they put these words up, these words do not become legal in all 50 states.

Using ProxyConn is like checking out with a full bag of cookies at the grocery store then having them take half the bag away as you exit - next the grocer decides to rewrite the ingredients on all the remaining bags because someone noted it had a missing promised ingredient.

I find it ruthlessly pathetic that more and more companies are practicing these bad business techniques. If they cannot rely on the quality of the service/product they provide - they simply steal and force you into being a customer. Buyer beware. Proxyconn is one of a few I have run into recently.

From now on, any internet purchases will be from an acct. Designated for such purchases. If they try to dip in without notice, they will end up empty pocketed.

Terms from Proxyconn Site:

Initial Period" means the initial term of payment (monthly, quarterly, yearly or as arranged) from the commencement date. The length of this period depends on the initial payment by the Customer. For nonpaying customers, the initial period is for the duration of the customers use of the service.

3. Fees and Payment
3.1 The Customer must pay the Fee in respect of the Service supplied by Provider to the Customer at the times and in the manner specified on the Providers website.

3.2 Any variation to the Fee will be at the discretion of Provider.

3.3 Should the customer not wish to pay any increased Fee when the next payment is due, they may elect to terminate this agreement.

3.4 Provider reserves the right to terminate any accounts that are not renewed at the expiration of their term.

3.5 Provider may offer the Customer an "Unlimited" or "Perpetual" service option. If the Customer paid for this option, Provider has the right to change the service option to the "annually", on the terms that the Customer would be receiving if the customer would select that option initially. If Provider exercises this option, Provider must reimburse the customer the difference between the paid fee and the fee for one year of the service at the option "annually". For a period of 30 days after exercising this option, Provider must allow the Customer to cancel the service for full reimbursement of the remaining part of the payment. Additionally, Provider may not exercise this option in the first 6 months after the Commencement Day.

3.6 At the time of the credit card submission, the Customer authorizes Provider to "pre-authorize" the Customer's credit or ATM card for the sum of the first payment.

4. Term
Subject to clause 12, this agreement will commence on the Commencement Date and, will continue for the Initial Period. At the end of this term either party may terminate this agreement. The term will automatically renew every period (equal to the Initial Period) on the terms that and conditions set forth herein so long as the Customer makes payments or in the case of nonpaying customers so long as they use the service.

Billing procedure - Your account is charged in advance every month for as long as the account is active. Annual subscribers are charged once after the seven days free trial. If you cancel as indicated above, your subscription shall terminate at the end of the monthly cycle. Cancellation therefore, stops any future charges. No refunds are applicable.
