EBay PayPal purchase protection policy bait switch software cell phone cellular CD piracy scam sucks ripoff

I purchased a "MOTOROLA TRUESYNC USB DATA KIT CD v3.0", for my niece, from Ebay user xmradioking on Aug-04-06. It listed a USB Cable in the item specifics and the total with shipping was $15.

What I got was a pirated copy of the software and no USB cable. Sorry this is so long but I thought everyone should know what he or she would face when making a claim through PayPal. They sent me these emails (I shortened these a bit):

In order to continue with the investigation of your complaint, we must request documentation to support your claim that the item is damaged or significantly not as described. Please obtain a document (such as an estimate or invoice) from an unbiased third-party, such as a dealer, repair shop, appraiser, or another individual or organization that is qualified in the area of the item in question (other than yourself).

This document should detail the extent of the damage or clearly explain how the item received significantly differs from the item advertised. Please do not proceed with any repairs or alterations to the item, as doing so will limit PayPal's ability to successfully resolve your claim, and may result in the cancellation of your dispute.

If possible, the document should include a serial number and description of the item, and the dollar amount required to complete the repairs necessary to correct the damage. This document must be on letterhead that includes the name, address, and phone number of the individual, business, or organization so that PayPal may contact them if necessary.

We must receive your fax within 10 days from the date of this message in order to proceed with the investigation of your claim. If we do not receive your fax within 10 days, your claim will be cancelled. We are unable to grant extensions to this time period.
PayPal is unable to reimburse you for any costs or fees that may be incurred in obtaining the requested documents. Any documents you provide may also be supplied to the seller in your dispute.

I didn't have a lot of time so I was only able to go to two places looking for the required documentation. One said they didn't do estimates and had no invoices. The second wanted ten bucks for an estimate of damage, but said I got a great deal on the software? Sure enough ten days later I got this Email:

I have nineteen purchases with 100% positive reviews. PayPal never so much as offered an Email address for reply and finding a phone number for complaints results in a futile search. There is no link to specifically report pirated software on EBay, or PayPal. I was going to mail PayPal the pirated CD, but I think Motorola might be more interested.

It is now apparent to me that the only way to avoid fraud (getting ripped off) on EBay is to avoid EBay and stick to genuine internet commerce sites. EBay doesn't sell anything to the bidder. But they do enable you to meet many sellers. Some you will definitely wish you hadn't.

Unless you have the inclination, time, money, and can find a willing authority within 10 days with an official letterhead that is knowledgeable about your item, PayPal will close your claim. Anybody have a USB cable I can get cheap? Hehe
