I am a member of the clergy, and I too was deceived by Circuit City. They sold me an apparently returned HP MX 704 17 inch monitor on 8/1 as part of a bundle with a new computer tower. It was not an open box item.
The only way I found out it was return was when it blow out on January 9, when I called HP and gav them the serial number. HP informed me that the monitor was previously purchased in December. I looked at the label on the box I happened to keep. Sure enough the box reflected manufactered date of August.
I purchased an extended warranty, but I was told it won't be honored until after the manufacturers warranty expire on 8/1.
I called the store's technology sales manager, Chris, employee Id number 092795 at 10:50 pm on 1/9. Chris told me, even though he aknowledged that such a sale violated corporate policy, that Circuit City will only follow its 14 day return rule.
A fraud statute begins when the fraud is discovered!
