Failed to replace defective product or give refund

Purchased product on 08/19/11; charge posted on credit card 08/22. No confirming email, order # or reference # provided. However, product received. But after 2 weeks it completely stopped working. On 09/09, tried contacting company at number listed on website ("Representatives available 5am - 10pm PST") but went to voice mail where message stated that mailbox was full. Sent an email to addresses listed on website. Received response from Matt, who indicated a replacement would be sent but that this would be the "last exchange", and asked for my mailing address. I provided this on 09/12. I sent follow up emails on 09/22, 09/26 and again on 10/04 and only after the 3rd email where I threatened to file a complaint did I received a response from Ryan, Sales Manager, indicating replacement product was due to be shipped THAT DAY. As of 10/17, I had not received it so sent yet another email, again threatening to file complaint. I received another email from Ryan, Sales Manager, stating one had been sent and should arrive no later than Friday (10/21). I wrote back, asking when it was shipped and requesting tracking number. To date, I have not received the replacement nor a response to my inquiry.
