National Fitness Misrepresentation of Contract/Dishonest Employees

My sister and I went into Ladies Premier Fitness here in Middletown with free 30 day trial flyers on February 18th. We hesitantly agreed to fill out paperwork for a membership, only because we were told by Autumn, the employee who signed us up, that we had three days to CALL AND CANCEL and our cards would not be charged. After some discussion we chose not to activate the membership; my sister CALLED on February 20th and told the employee she spoke to that we had decided against joining the gym. She was told that that was fine, everything was taken care of and that our cards would not be charged. I discovered on March 20th that the gym had withdrawn the monthly fee from my checking account. We have called the gym and the billing company (National Fitness) and they are completely unwilling to help us even though we were lied to by two employees about the correct way to cancel our contract; they have told us that in order to cancel your contract during the three day grace period you have to PROVIDE SOMETHING IN WRITING AND THAT A PHONE CALL WAS NOT ENOUGH TO CANCEL YOUR MEMBERSHIP. We made the effort to call and cancel - if we would have been told that we had to provide something in writing we certainly would have done that too. Now, in order to cancel our contract, we have to pay 85% of our yearly contract which amounts to $819.69. This is incredibly frustrating because both my sister and I are students and we cannot afford to pay $820 - we couldn't even afford the $50 monthly fee which is why we decided not to activate our contract.

I realize that we signed a contract, but the fact is we were verbally told one thing while Autumn sat there and wrote something else on the contract. For example, we were verbally told our contract was for 12 months; our contract says it is for 36 months. We were told verbally that the two of us were going to be on a spousal contract and consequently received a discounted rate; we are actually on two separate contracts and now have to pay two separate cancellation fees totaling over $800 a piece. We were told verbally that all we had to do to cancel the contract was call the gym within the first 3 days; in actuality you must provide something in writing.
These people are not honest and their business practices are not ethical in any way, shape or form. Stay away from Premier Fitness and especially any gym that uses National Fitness as their billing company!
I am interested in filing a Class A lawsuit against this company; if anyone else is interested please respond to my posting.
