Item 1) Dispute of charges:
Though it had not been used in 6 months, I paid for the full 12 months of membership and canceled it by phone in September. I was billed again in October, when questioned they said it had to be canceled in writing. I filled out the cancellation form October 10 and delivered it in person, we discussed that this was the last payment and I reluctantly agreed to the September and October 6th payments (13th and 14th months) and I paid them. I also rescinded permission to use my credit card again for any reason. I called my credit card company October 12th to ask that any charges from this company in the future not be paid and they no longer had permission to use my card. They charged my credit card again Nov. 17th. The Credit Card company accepted the charge, they only cancel accounts set up as reoccurring charges, not charges just made on a regular basis.
Item 2) Crime: unauthorized use of credit card.
Whether or not the 15th month charge was legitimate, both this company (On October 10) and the credit card company (October 12) were told Delaware Swim and Fitness did not have permission to use my credit card number again. This company denies being told, however the credit card company fortunately does have a record of my instructions to them on Oct. 12. And will be reversing the charge. Isn't using a credit card number without permission to use it a crime?
