Beating And Assaulting PatientsI am creating this page to inform visitors about treatment I received in 2004 at Research Medical Center in Kansas City, Missouri. I was badly beaten and assaulted at Research Medical Center on June 11th on or about 1 to 1:30 PM in the afternoon. The events of the day started when I took my doctor's advice and went to the emergency room at Research Medical Center. Dr. Rebecca Burfiend was treating me in 2004 with cortisone injections in my neck. I was diagnosed in 2004 has having either ruptured or herniated disks in my neck. Dr. Burfeind said she was unable to prescribe or write prescriptions for medication. Dr. Burfeind told me if the pain got so bad to go on to the emergency room at Research Medical Center. My reason for being at the hospital that day was to be seen in the emergency room for severe pain in my neck, numbness in arms, back pain and migraine headaches.

After I arrived at the emergency room, I signed into the reception area of the emergency room at Research Medical Center and waited to see a nurse. When my name was called, I was directed to a room where a balding individual introduced himself as Dr. Ables. I was with Dr. Ables no more than 4-5 minutes at most.

Dr. Ables spoke in an annoyed monotone of voice and told me matter of factly and candidly;"there was nothing wrong with your neck... I don't see any indication of injury." I brought MRIs and x-rays with me detailing information about my neck. Dr. Ables didn't care about why I was at the hospital or review any medical records, mri's, x-rays and CT films and CT Scan reports that I had brought with me.

I did questioned Dr. Ables negligent and abrupt finding that there was nothing wrong with my neck by stating; "There must be some mistake. You must have my name mixed up with someone else. Please look at these medical records. They have what you..." Dr Ables cut me off abrubptly in mid-sentence; "You will have to leave the hospital now. I don't have time to play games!"

I was astonished at this treatment and at the instant diagnosis of total good health. Especially in light of all the medical records that are the polar opposite of Dr. Ables diagnosis.

I was polite when I said it and didn't use a loud voice or any obscenities to colorize my remarks. I just simply said; "You sir... Shouldn't be allowed to practice medicine... You must have received your medical license from a cracker-jack box." This was my opinion of Dr. Ables for making such a negligent diagnosis as he did in my case and ignoring medical records.

As I was attempting to leave the emergency room, I was approached by 5-6 security guards at Research Medical Center. I believe Dr. Ables may have taken personnal offence at my comments about his medical care by doing the following actions. Dr. Ables told the research Medical Center security guards that I was tresspassing or something along those lines. Dr. Ables called security to have me thrown out of the hospital on the basis that I was tresspassing. These security guards started barking orders at me to leave the emergency room immediately but at the same time restraining me there by blocking the exit. I didn't know what to do. They barred me from leaving for like 15-20 minutes but kept yelling at me to leave. It was riduculous.

One security guard stamped on my foot with a pair of boots to inflict injury on me and to keep me from walking out. I sprained my ankle out of this. I then realized that these people intended to possibly injure me seriously and I was afraid for my safety. Another security guard almost hit me full force me in the face by raising up his forearm but brushed my chest instead. It was enough to knock me back, even though I didn't take a full blow. These security guards at Research Medical Center didn't care that I was an established research medical center patient in bad health wearing a thick neck brace. I was also carrying radiological films of my neck and spine.

I have been suffering from severe pain in my neck from a June accident in which I was rear-ended at a traffic light. I was wearing a hard foam collar at the time of the assault in the hospital. The injuries to my neck from the car accident were very real and I was previously treated by a doctor for this for 18 months until my auto insurance was capped out. I was told if I came back to the emergency room seeking medical treatment that I would be arrested for tresspassing.

After the Research Medical Center security guards finished threatening, belittling and yelling at me, I was finally allowed to leave the emergency room. One of the security guards ordered me out into a busy street and away from the entrance of emergency room. One security guard told me to start walking the street and inferred to me like I was homeless or something. The hospital is in a high crime area. I was afraid for my safety because of this also. These Research Medical Center security guards had no regard that I was wearing a neck brace for an injury. The Research Medical Center security guards went out of the way to make me walk with my injured neck into a busy road where I have could have been hit by a car.

I sweated profusely on that hot 92 degree June day as I was walked back towards the main enterance of Research Medical Center. I was going to see Dr. Burfiend who was treating me with cortisone injections. Anyway, I walked about a half a mile down a street to the entrance to Research Medical Center where my car was parked.

As I walked through the main entrance of Research Medical Center, I pondered what had transpired down at the emergency room. I was going to see Dr. Burfiend on the 3rd floor to notify her that the emergency room turned me away for medical treatment. Afterall, Dr. Burfiend is the one who advised me to go to emergency room in first place. Telephone records can corroborate communication between Dr. Burfiend and myself the night before.

I wanted tell Dr. Burfiend about what had happened in the emergency room and to schedule another appointment and get a referral to a pain management clinic that treats neck pain and injury as soon as possible. Dr. Burfiend only injects cortisone to reduce inflammation and also trigger point injections.

As I walked through the main entrance and before I got to the elevator, I was roughly grabbed from behind and by my neck by several of the same Research Medical Center security guards who had approached me in the emergency room. The Research Medical Center security guards rushed at me; tackled and dragged me away from the elevator out through the main enterance of the hospital. The Research Medical Center security guards stepped on my x-rays and medical records, mri-s, CT scans that I was carrying. I have a clear footprint on one of the film jackets.

They forced my arms in an unusually awkward way by forcing me into handcuffs. These guards choked me about the neck. I had a neck brace on at the time and these people went straight for that neck area. I was punched and hit in the back. The security guards tried to force my face into the sidewalk as I tried to hold my head up off the concrete in an effort to not lose any teeth. This caused me to pull and strain muscles in my neck and back.

As I was dragged through the main enterance, the whole incident was caught on surveillance cameras. Bystanders including ambulance workers, nurses, patients, food service workers among others who had observed this incident.

I was professionally dressed and clean shaven. I was not under influence of drugs or alcohol and didn't demonstrate any behavior that would warrant me to be severely beaten by hospital security and charged with tresspassing. To say the least, the Research Medical Center was negligent by allowing security guards to beat up their up patients. My appearance was not out of order and I didn't project myself in such negative behavior to warrant being beaten up and injured by sexurity guards at Research Medical Center in Kansas City.

I was yelling for them to stop choking and beating me. I screamed out; "stop choking me... I have a bad back and neck" I was in a neck brace at the time of this attack. It was then that I realized these people were trying to severely hurt me or worse. The security guard went straight for my neck brace. These people didn't care about my health or safety.

These security guards cursed at me with vulgar obscenities like "you will learn this time, " "can't get enough huh, "drug addict, " "motherf*er" among others obligatories. When I was thrown down to the sidewalk the first time, I came straight down on my right elbow shattering the bone. I later required surgey to remove bone chips. The elbow healed abnormally with extra bone formation. It is now impinging a tendon for the triceps muscle and causes me lots of pain and weakness in right arm. It is possible in the future I may have to have more bone removed from the elbow. I was treated very poorly to say the least. I wasn't given the common courtesy of a human being much less the respect as an established patient of Research Medical Center.

I also sustained a compression fracture to a vertebra in my mid-back area. While I was on the ground, one security guard kept hitting me in the back with his knees. I was kicked multiple times in the back and punched in the back. I also developed deep tissue bruising with bruising that was purplish to black. I didn't have any of these medical problems before arriving at the hospital.

After being roughed up and beaten on the sidewalk, they put me in a late model Ford Taurus. This man threatened me inside the car and and this lasted like 10 minutes or so. The security guards drove me back to the emergency room where I was originally. They talked amongst themselves about what they planned to do.

When the police showed up, they pointed their guns at me and one officer said he would blow my brains out if i moved an inch. The police told made to lie flat on the ground in oil and grit from vehicles and ambulances that come in and out of the sally port area of the hospital. I thought for a time that the officer might really shoot me. I never imagine something like this would happen to me this day.

I had no idea what else the hospital told the police. They were using deadly force against me. I thought I might actually die! The police officer kept yelling, "where are the drugs!!! Where are the f*ing drugs... Where is the f*ing gun!" I didn't know what to think. I didn't know what to say. I didn't say anything because I thought this guy was going to kill me.

Days afterwards, I spoke to the CEO of Research Medical Center called me and apologized about the treatment and said I should forget about it. The CEO of Research Medical Center was holding the video tapes in a locked safe in his office. I was told there was nothing useful on the tapes.

I have tried to retain a lawyer to represent me on a claim against the hospital, but very suprisingly I have tried all over Kansas City to no avail. I have been told by dozens of lawyers that the type of legal help I need has been restricted by some type of reform or something making it hard to recover. Lawyer out of state couln't represent me because they weren't licensed in Missouri.

It is aparent that the hospital violated my civil rights and broke various state and federal laws by throwing me out of the hospital, injuring me and having me arrested for tresspassing. When they refused to treat me as required under federal law much less severely assault me and slander and defame my name and reputation.

The hospital concocted false charges against me to justify the assault and deadly use of force and cause a malicious prosecution against me for trespassing. They lied to the police about allegations of a handgun and drugs which very much endangered my life. I could have been shot. Maybe it is just me, but I think these people are negligent as hell.

The police cited me for trespassing and an ambulance transported me to St. Luke's hospital. The paramedics of this ambulance may have observed me being assaulted at the emergency room.

There were many people around that day who witnessed the beating. Also up to five surveillance cameras at differing angles and locations caught footage of the assault. Thay day it was my sole purpose to get medical treatment at Research Medical Center. I wasn't looking to get possibly killed.

I was barred by the police department for filing any charges against the hospital or security guards. The hospital is pursuing prosecution against me for tresspassing. Has anything like this happened to any of you?

I didn't think something like this could happen at a hospital in America. I didn't think anything like this would ever happen to me. Maybe the other person but not me. I couldn't fathom the idea that this would happen in real life. I still suffer from injuries to this day. I can't obtain representation because lawyers have advised that damages are severely restricted and the discourages people from filing claims. Maybe somebody reading this can help me.
