Advertised Offers Reneged With Impunity

This is a letter we sent to the Board of Director, Dish: "We switched from Direct TV to Dish effective March because of some highly favorable promotional inducements: better programming (local channels in HD, Channel Versus, etc.) and better equipment. Also included in theinducements were a $50 rebate and five free movies. We attest to Dishsquality programming and superior equipment, which leaves its competitors in the dust. Nevertheless, we will happily return to DirectTV because Direct TV has something that Dish lacks: integrity and excellent customer service. (Termination is effective when our early termination penalty is
reduced to $200 because Direct TV will pay this penalty.) Our complaints include the following:

$50 rebate — we mailed the requisite form on March 22. We were advised thatthe rebate would take up to three months to receive. To date we have not received our rebate and we recently contacted Dish. We were told byyour customer service representative (rep) that we would have to deal directly with the firm that handles the rebates. Your Dish rep said that although Dish represented in promotional advertisements that a $50 rebate would be issued, Dish was blameless nor responsible for the advertised rebates nor would Dish intercede on our behalf. We were instructed to call a number for follow up (908-755-9008). We called that number and the recorded message said to provide an extension numberthat was not provided by the rep. After some experimentation, we did talk to a live human who provided an extension number. We have left four recorded messages, yet no response has been forthcoming.

Fivefree movies — we were promised five free movies as another inducement by your rep at the time of our enrollment. To date, we have not received our five free movies. We asked the same rep about our free movies during the conversation above. The rep was astonished to hear what was promised. The rep demanded to know the name of the rep that made the promise. We did not record the persons name at the time of our initial enrollment. Without a name, the rep said we had no recourse because that rep had no authority to make such a promise; therefore Dishwas blameless and not responsible.

Dish has reneged with impunity; yet our recourse results in early termination fees. We are also sending copies of our letter to Utahs government agencies responsible for investigating fraud and poor business practices. We arealso posting this letter on complaint on line websites. We wonder how many others were promised a rebate and five free movies, which were not forthcoming. This letter is on their behalf too."
