October 29th I was shopping for some last minute halloween decorations and costume pieces we ended up in electronics and bought a 40 inch tv along with 27 other items we paid and noted the clerk forgot to charge us for the t.V. Wall mount so we pointed it out and made a second transaction then pd and went to leave as we exit the front doors i am already out the first set pulling the cart with my newly acquired t.V. On top behind me. My wife followed but had bags of merchandise in her hands so I had to grab the t.V. To stop the doors i thought from pushing it off as I exit. As we head to the truck my wife starts to tell me the greeter had wanted a receipt and was actually trying to take my t.V. Which was way to big for her to lift so she was just trying to pull it off and let it fall angered now but figured not worth a wasted breath to go back and tell her off and explain that she just commited attempted theft and had assaulted me as well as unlawful detainment. I am headed to my truck still and am almost 80-100 feet from the store when i hear the word someone stop him he just stole that t.V. Next an employee is chasing me screaming i need a receipt for the t.V. Sir i turn around and walk quickly towards him and tell him off explaining again that the t.V. Is paid for and unless he is arresting me to f*k off i turn and walk away and he follows shouting at me that "we aren't letting you leave with the t.V." I turn around again and noted several people running towards us some in walmart clothing and some not I said i haven't done anything wrong he tells me I am under arrest for theft and grabbed my shirt at this point realizing I am about to be jumped I push him away and am jumped they now change the arrest to "assault". So as they have me in a (1st employee) choke hold (2nd employee) arm twisted behind my back with thumb being relocated to my wrist and the (3rd and 4th employees) taking turns pulling down on the front of my shirt in the opposing direction of the 1st employee thus causing the shirt to be cutting into the back of my neck I tell them several times to stop and call the police they refuse I ended up getting my wife to call the police to report the assault when she does she is told by the police that they are not going to attend unless a walmart employee calls my wife ends up handing our phone to a walmart manager and then when she is done with the call my wife asks her for our phone back the walmart employee snarls at my wife to shut up and back off or she will charge her with assault too. When the police show up they cuff me and search me then go talk to walmart staff and tell them that i had the receipt and the t.V. Was purchased and i had no stolen merchandise. The police still arrested me and charged me with assault x1 assault while resisting a lawful arrest x2 and mischief x1 because the truck they kept slamming me into got dented from bouncing my head off it. Almost all of this is caught on tape.in court the crown originally denies the video exists after I adamantly insist that it does several times I finally say if it doesn't exist then why is it listed in the disclosure. The video footage finally shows up 2 day before I go to court again on aug 12 thats 10 months and i only get 2 days to view and build a defence. Take note I am mid trial now waiting to finish (jan 14). I have no lawyer because at the time of incident I was a 100,000 plus a year income (too much for legal aid) and since the incident am only a 45,000 a month income i have 5 children and cannot afford to live anymore but recently have managed to pull out of my depression and am starting to gain control of my downward spiral I have lost my home and am renting a house all of our possessions lost and my flawless credit destroyed thankfully my wife took the time to sit me down and explain if i don't change they are leaving me... Appointments with doctors and shrinks are being made. So walmart I hope you are proud of your accomplishments but rest assured I WILL seek compensation and no longer ponder suicide so this problem will not just be blown away.
