Ripoff: took a bank check for 163.61 from me for a Konica Minolta DiMage Z5 Digital camera that I won on ebay on 7/20/06 and has not delivered on the camera

I purchased a Konica Minolta DiMage Z5 5MP 12x/4x advanced digital camera on 7/21/06 from Clifford Van Ness, CEO Spokane PC Team through ebay. He stated he was having issues with ebay's paypal and asked if I wanted to send him a check for the item. I asked if we could use a credit card and he stated he was not set up for that kind of purchase. So not wanting to wait for a regular check to clear a Washington bank I sent him a certified bank check from my bank (Citizens Bank) (I have a copy of the check sent vis UPS next day also have those receipts signature required). He then said he has to wait for check to clear his bank and he would ship the very same day.

He notified me when it did and said the camera was packaged and ready for delivery; I recieved an email from Cliff that my check had cleared his bank (7/28/06) "I'm going to be shipping out today - Wahoo!". Today is the 8th day of August and still no camera. I emailed Cliff about a tracking # and no response when questioned about ETA of camera he offered me a refund seeing as I was in his opinion willing to wait. When I said that I wanted a refund because I felt that I was being very patient with him and his issues and I felt that he was not being honest with me I received a very nasty email telling me that basically I must be an idiot and did not read everything he sent me and that I have to prove to him that I sent hin a bank check (and it needs to be noterized certified copy of the check that I say was cleared by his bank... I kept my copy of the check).

He also wrote that a refund processing may take up to 3-4 weeks. I have saved all of our correspondense thru email. He also said "The only right you have regarding a request for a refund is this: a) A right to get the item you paid for; b) A right to request a refund. He mentions litigation and the length of time it will take and that their will be no contact between us and he goes on with "which sucks, because i've already offered a refund to you before you thought of asking me for one. (Put a checkmark in the "smart" column for cliff." Mind you, one of my most recient emails to him was about delivery date and tracking # which he could not give me so when I asked what was up he again offered me a refund which I accepted and that is when I got a very long email about how long I would have to wait for a refund, litigation, court, etc. And then goes on to tell me how I should have emailed him about my refund.

I just can't believe how this has turned out I have printed copies of all our email communications. Just a note he also implies that my spam blocker may have diverted some of his communications. All my spam blocker does is send it to my junk mail and their is none. I realize that $163.61 may not be alot of money to some people but I work very hard for my money and I don't like being swindled. Cliff Van Ness also has the ordasity to end his emails with Christian like closing such as Peace and safe journeys and I wish you peace etc; a good Crhistian would never take advantage of others.

Please pass this on to the Spokane Better Business Bureau and I plan on filing a complaint with the Spokane Police Department. This is fraud in every sence of the word.
