Here are the facts:

My 2-year contract with Alltel ended 7/20/04
October 23rd I ported my 2 phone numbers to Verizon.
November 1st I receive my October bill from Alltel; to find that I have been charged a termination penalty totaling $400.00
I called Customer Service and find out that my calling plan had been switched in august which automatically added a 1-year contract.
This was news to me since I NEVER requested, consented written or orally to any change to my plan or contract.
After 45 minutes on the phone, the Alltel rep told me that the charges would be waived but I would not get anything in writing but to just pay the difference. Choosing to trust I did.
November 30th I receive a bill from Alltel with the $400.00 still being charged
I went to the Alltel Store that I have always dealt with, spoke with Ken Mcelheran (813-972-7110) but he was not able to correct my account but he could not identify who or why my calling plan was changed and I had to go back to customer service.

I phoned this problem in when I received my October 25 bill. Moreover, I was told it would be adjusted but nothing would be given to me in writing, I have just been informed that it was not corrected, so now I will correspond this way so there is a record.
As I mentioned above I called on my Oct 25 bill about a disconnect penalty fees (813-695/ 813-629-6763) totaling $400. I talked to the department that handles this subject and was told that after my 2-year contract expired I was rolled over into a new service plan that automatically added a 1-year contract. All of this was done without my knowledge, written or verbal consent and use. Please delete these inaccurate applied penalties. Today is November 30 if this is not corrected by Dec 3 I will forward my complaint to the FCC, Florida Public Service Commission and Florida Attorney General.

Thank you for choosing Alltel as your wireless service provider.
After careful review of your account, it appears that you took advantage of a promotional rate plan. A new contract was added at that time. Unfortunately, we are unable to adjust the charges.

I NEVER requested any promotional rate. You have No written or verbal agreement. This looks like I was SLAMMED... Its very suspicious that when my 2 year contract ended I was put into what you are calling a promotional plan that I never asked for, wanted or even knew about.

This not exactly what Alltel is doing to me. What Alltel is committing fraud. I say again, I never ever change anything on my account period. And I Definitely would never have agree to any new contract with Alltel. I could not wait for my 2 yr to end. So I ask Nicely one more time.
Please delete these inaccurate applied penalties. Today is December 1 if this is not corrected by Dec 3 I will forward my complaint to the FCC, Florida Public Service Commission, Florida Attorney General and the local investigate news channel

I apologize for your inconvenience. We do not change our customers rate plans without first receiving the customers consent. Any change in rate plans will result in a contract extension. Unfortunately, we would be unable to adjust the early termination fees
