Free Credit Profile ripoff, unauthorized charge to my credit card account slow prossessing in crediting me $79.95. Slow prossessing the business that doesnt give a dam slow prossessing San Luis Obispo California...
Free Credit Profile offered me a month free trial for credit report usage. I called and cancelled this service on 12/4. After a few days I was checking my banking statement online and found a charge of $79.95 taken from my account. I had to call my bank to see who this was because online bank statements don't have this information.
They advised me it was a company called Free Credit Profile and gave me the 800 number. I called them immediately, this was the 9th of December and told them I had cancelled this service and did not want it and was charged for it and the amount.
The person I was speaking with truned me over to the supervisor to help me and his name is Matthew, I don't know the last name. After explaining my situation he advised me I was still showing in a pending status and of course I told him no way should I be in that status or charged this amount of money. He then asked if I would send him a bank statement showing where I had been charged and I did just that confirming that he would go over to the fax machine and pick it up right away. I told him I would be faxing this from my home.
I never hear from him for about a week, nothing! Then I called back on the 14th of same month and spoke to a gentleman Jason who was very nice and put me on hold to ask Matthew (the supervisor) what was up with my situation. He came back on the phone to tell me that Matthew said he had forwarded it to the accounting department and I should be receiving an immediate credit.
After a while longer, a little more than a week later, I called back again and luck had it that it was Jason, the first person I had spoken with. He couldn't understand why I had not received this credit. Note: in between the 2nd & 3rd phone call, I wrote a stern e-mail to the attention of Matthew with No Response what so ever. Now when Jason came back to the phone he advised me he had spoken to the accounting dept. Who had assured him that I would be receiving full credit.
My last e-mail to them was on January 13 to the same e-mail addy I have been sending all my messages to, however I put to the attention of the Accounting Dept. Manager. I advised them of the situation and that I want immediate credit. I also reminded him that this was an Unauthorized Withdrawal from my checking account and therefore is considered a fraudulant act and there would be leagal repercutions. I also advised him that I had already arranged an appointment with my Attorney this Monday, January 20 to start leagal action for I felt that by not hearing from them only confirmed that they were not taking this matter seriously and since I had not heard anything from them this was the only choice I had.
Now I heard from Matthew within the two days I gave them which was Thur/Fri before the Monday of 1/20/03. Matter a fact I heard from him almost immediately on Thursday with an explaination that the accounting department had not issued my credit due to the pending status I was in. I take this as a bunch of BUNK and only a Delay in what I was going to have to do. I told them I would be charging them for much more than $79.95 because I will be including lawyers fees, court cost and pain and suffering. I am disabled with sever pain from a disease I have and having to take time to constantly deal with this matter that should not have taken place in the first place only caused me more pain and suffering.
So, this is where I am. Today, Monday, January 20, m 2003 there is still not a sign of reimbursement and I will be speaking to my attorney today and making arrangements to file for legal action to take place. I would advise STRONGLY that when you are offered a free sample on ANYTHING, DO NOT GIVE OUT YOUR CREDIT CARD OR A CHECK BY PHONE, PERIOD! If a company really wants you to try for a trial period, then they will allow this and cut it off when it is over. Leave it up to them to contact you via E-mail ONLY to see if you would like to continue this service. These people offer these trial periods as advertisements and they are TAX DEDUCTABLE so don't for a minute think you are doing a dishonorable act to them, which I am sure you don't, but there are some good hearted people that do and I am saying to you DON'T!
Lastly, I wish you to know you have leagal rights and can take these people to court and make them pay more than reimbursements. But, please, please, please, make sure when you are considering taking part in these that you either do what I said above or READ EVERYTHING AND MAKE SURE YOU UNDERSTAND IT COMPLETELY! I am a person that keeps detailed documentation and I can stand up with this in court and all contacts and conversations, giving time, dates and to whom I spoke with. If I had anything to add more than what I have said already, I would say, start being in a habit of documenting things, name, date, time and what was said.
This will help you more than you know. This is what an Attorney needs and Judgement will come out in your favor I would say most of the time 100%. It is time we stand up for our rights and during this time of all these big corporations ripping off people and committing to fraudulant acts, don't be affraid to fight them. Just have your docuemention ready and that is what builds a case and is what the lawyers like to see. Most of the time it is settled out of court and you will be the victor.
