Bason Computer Cavalry Storage Rebate Consumer Fraud

Two seperate 500 Gb hard drives were purchased from Buy.com and rebate paper work was sent to Bason Computer as specified. I had to order for my friend because she is a Bulgarian and speaks very little English. Upon checking our rebate status online they were found to be denied.

Reason: No Receipt.

I called Bason Computer rebate division and was told that we had not sent in the correct receipt. I asked the lady what receipt it was that we should have sent in and she told me that we should have received one by email. I asked when and what the origin of this receipt. She could not give me this information. She informed me that we had submitted the wrong receipts and that we were denied and there was NO resubmission and that was final.

I told her I felt as if this was a scam and I would report it to the FTC and BBB. She then informed me that I was threatening her and hung up.

As of this day myself nor my friend has received this so called email receipt. We had sent in the only receipt that was sent to us directly from Buy.com which has the customer purchase order number and description of item purchased. I called Buy.com and they informed me that this was the only receipt that they send out and no more information is on the receipt because of security reasons. A receipt by definition is: a writing, acknowledging the receiving of goods or money. I believe that we sent in a proper receipt.

A complaint was sent to Better Business Bureau and they contacted Cavalry but Cavalry refused to answer.
A complaint was also sent to the Federal Trade Commission and their reply was that this matter is too trivial for investigation. Certified letters were sent to them as follows:

To Whom It May Concern:
I purchased a 500GB USB 2.0 Model CAUO37500 on 21 June from Buy.com on the internet. My decision to purchase this product was based upon your offer of a mail-in rebateof $40.00 (offer). My purchase of the product constituted my acceptance (acceptance) of your offer, creating a binding and enforceable contract between us.

I have performed my obligations under the contract. I paid the full purchase price and then proceeded to fill the rebate form provided by Buy.com and you. I included all the information requested to process my rebate, but to date I have not received a check in the mail for $40.00.

I respectfully request you process payment and mail it to me at the address indicated within 30 days. I have re-attached all information originally sent for your convenience.

If I do not receive payment in full by (date 30 days from mailing), I will begin legal proceedings against you and will file complaint reports with the Federal Trade Commission, the Attorneys General of the states of (your state) and (the company's state), as well as selected consumer advocacy publications and local and state consumer affairs departments.

I am sending copies of this letter to these agencies and organizations to encourage your compliance. I am also filing a report with ConsumerAffairs.com for inclusion on their Web site.

Thank you for your prompt attention and resolution of this matter.

So far no answer and no rebate. I think his company should be investigated by someone or perhaps a Class Action can be put together.
