A salesman from Capital Merchant Services (CMS) in Denver, Colorado sold me a credit card machine through his company CMS never advising it was a lease and another company, MBF Leasing was involved. I would pay a set amount each month and there were NO minimum fees, annual fees, statement fees, batch fees, etc.

Three weeks after the machine was hooked up all different fees were being withdrawn from my bank account. When I recieved the contracts in the mail the contracts were filled out with additional information that was not discussed at the initial signing. I quickly called each company with a breach of contract however no one would listen.

This was the first I found out I was in a lease with MBF. CMS apologized on the salesmans behalf claiming he was new and they would refund my money and would pick up the machine but after several attempts to contact them they never did provide a refund nor would return my phone calls. I closed my bank accounts to prevent future withdrawals from these companies.

I started receiving phone calls from MBF, several a day, advising me that I owe them money. I now have recieved a summons from MBF (Northern leasing) advising that I owe them about $5500.00.

For what? I spoke with a lawyer in NYC whom advised me he has tried over 60 cases against MBF (Northern Leasing). After further investigation on my own I found that a NY Attorney Krishan Chittur filed a Class Action Lawsuit against MBF (Northern Leasing) claiming a "scheme to entrap small businesses into equipment leases with undisclosed charges and eroneous terms".

This Class Action Lawsuit was signed on April 7 by Justice Shirley Klein Hetiler. I am planning on joining the suit and would suggest each person join as well. How else will these companies be stopped?
