It is a womens retail clothing/shoes fashion boutique started around 25 years ago by my parents. I'm the current manager and I'd like to join the civil suit against Northern Leasing.
This is part of a letter to a lawyer who is sueing Northern Leasing.
Back in 1999, a credit card machine agent, Mike Bresette, came into our store and had my father supposedly signed a 48 month 'non-cancellable lease' with 'Golden Eagle Credit'. I did some research and the the mother company is 'Northern Leasing'. They were debiting his bank account via ACH approximately $99 every month since August 1999. When I took over as manager a few months ago, I was reviewing his statements and surprisingly found some unusual, continuous ACH debits from the bank account for the past 10 years. I asked him what this particular debit was and he was under the assumption it was part of our current Merchant Service fees. I acted and called his bank and contacted the leasing company and they sent me a copy of the 'non-cancellable lease' They mentioned they didn't have the original lease, only copies. After ongoing hours of research online, I found out several small businesses like us have been targets by Northern Leasing and several of them have been tricked into signing these types of leases.
I'm requesting to be part of the civil suit that your firm has against Northern Leasing. They have been wrongfully debiting our account for almost 10 years. The lease states we were leasing a Verifone machine along with a pinpad, but in fact starting in 1999, we only owned a Hypercom with no pinpad. As a matter of fact, the agent Mike Bresette set us up for the Hypercom near 6/11/99 and then weeks later he used our bank information again for the Verifone machine on 8/13/99, which we never received. I contacted the Golden Eagle/Northern Leasing again and they faxed over an acceptance letter, which on top states it's a 'verbal delivery and acceptance' form signed by another Golden Eagle/Northern Leasing agent over the phone. This is fraud since we never received the machine. We still own the Hypercom machine as of today and I have confirmation from my merchant service that it was the only type of machine used since 1999.in the end, my father has paid over $11,000 for a credit card machine which we never owned/used and now the Golden Eagle/Northern Leasing is requesting him to 'buy out' the machine for $500 in order to stop the lease. I stopped the ACH with Golden Eagle/Northern Leasing from the advice from our bank and the advice from other merchants were were frauded by Northern Leasing and their agents.
Please contact me ASAP and send me some paperwork so we can file against Northern Leasing.
