Refinance left us a victim of Home Equity Fraud in 2001. We Could not afford our own property Taxes, Insurance etc. Lender stole our Escrow account basically. That screwed up lender sold us to Homecomings within just DAYS.
They knew the deception of the refi. HomeComings must have known too, because they did everything in thier power to get us to Foreclose on our home, our payment went up over $200 within the first year. They insisted we were late on payments saying they were due the 1st of the month although all documentation I provided showed due date of the 19th of the month.
Thought we cleared that until we had again over $600 in late fees. When we fell behind by one month, they had it recorded as 4-6months. Had to file BK in 2003 because of this to save our home. Payments even went up after filing BK, when calling in payments each month, we would be told a different amount was due, maybe higher, maybe lower. One person would say we were up to date, the next month we would be behind 3-4 months??? Now our payment was $380 higher, they told our Trustee that we had no Insurance on our home, and held all payments in a "Suspense Account" causing additional late fees, and major issues with our BK. Our credit is ruined.
Our payment is $380 higher and does not include taxes or insurance. Our original loan DID. Still cant figure that one out. So, our equity in our home skyrocketed we could sell our home and payoff the BK and still make out with about 80,000. This is our home. We built this home as ours, we have a familty here. So, we would try to refinance. That started in February of this year.
After hundreds of attempts to get the attention of a lender that our payments are all timely, provided all documentation, all bank statements, anyone would agree Homecomings was in the wrong. Thier "FEES" all of this nonsense. But, no one will refi you when your mortgage company says you are 4months behind. They would not cooperate to give payoff info, our Trustee saw all payments as late. What a mess. It took a trusted (and determined) family friend almost 6months to help us to refiance, we still have had no response from Homecomings as far as a payoff amount, so we overpaid them in our payoff hoping to recieve back the money they owe US by fighting them with all our Proof and documentation.
Now, after finding this website, I fear we will not have that option. They have taken what was not thiers to begin with, in hopes of stealing someones home, someones future, someones dreams, all because of company greed.
We closed on our new loan today, and Homecomings has still not responded. Definetly need a class action on this "servicer" of loans. This deception ruins lives. Any info would be appreciated.
