Cheating me during a refinance with another company

I would be interested in any ongoing class action suits against Homecomings Financial.

I never had a problem with them until we sought to refinance our ARM mortgage. However, everything has gone wrong since then. First, we never chose Homecomings Financial. Our loan was sold to them. With the initial mortgage company our payment would have gone up about $100 with the ARM. With Homecomings it was going to raise over $200 so we felt pressured to refinance a lot sooner than we would have liked. However, we did find refinancing at a very good rate.

Now, let's get to what went wrong. The new mortgage company requested a payoff quote which they got and paid. Several days after the money was disbursed, the Homecomings contacted the services that disbursed the money claiming that it was short $1480.26 which is more than twice our monthly payment for our home. Considering we have quite a bit of equity in the home, we cashed in on a small amount of it to pay off a couple of little bills. Thankfully one of those little bills was enough to stop payment on to pay this other amount to the mortgage company. The reasons stated for the extra amount was payment late for November... Now the payment isn't considered late until after the 15th and the payoff amount was received on Nov 13. On top of this I just received an automated phone call from Homecomings stating that I'm late for my November payment, of the sum of $846.56, when they just received this whopping amount of money to pay off the entire mortgage which they claimed was short the 1480 stated above. Now, am I going to be charged more, such as adding this amount I was just told over the phone to the other amount they claim the payoff is short?

Now, the monthly payment has always been paid by us on the 1st of the month by automatic draft, however we initiated the refinancing in October and the new mortgage company advised us to stop the automatic payments because they would have the paperwork done before Nov 15 and they did. Homecomings did take out the November payment but I did a charge back because the autopay was cancelled, although they try to claim it wasn't, because the new mortgage company already had the payoff quote. At that point all we were waiting for was the appraisal and my husband's employment verification. I needed part of that money that would have paid that mortgage payment for the appraisal fees. It's been a bad year for health issues and other financial burdens. I called there specifically to do that so how can they say it wasn't?

So, I'm being cheated by this company and will be gathering the evidence this coming week... Nice thing to have to do during a Holiday week, eh? If there is a class action suit already in progress, I would appreciate information about it so I may contact the attorneys with my issues.
