My husband found an ad on craigslist listing regarding a discount on some hardwood flooring. The reason the discount was being offered was due to an order made for a previous customer who never completed their construction process on their home, so the discount was being provided to help the company recover some of their losses.
My husband, my mother and I live in Sarasota, so when my mother and I made the drive to Avon Park to see the material it took almost 2 hours of driving - 1 way. The material that was supposedly available was not at the showroom as we expected, there was only a couple of samples available for us to see. When I asked where the large quantity of product he said he had available was, he told me it was beng held at the distrobutors warehouse. Being an interior designer, I know this is not an uncommon practice. We talked for a while, he even had his underling go to the store and purchase beer for all of us; my mother took the beer he offered, I declined since I was driving back.
The day we visited his store in Avon Park was Saturday, the day before Easter Sunday. While at Creative Floor's showroom I went outside a couple of times to consult with my husband on the phone. When he learned the showroom offering the discount was in Avon Park my husband immediately told me to not buy the product. After my husband told me to leave Creative Floors I told him the address was listed in the craigslist ad he emailed me so I didn't understand why it was an issue since he was the one who sent me the craigslist ad. Danny had to do a lot of talking to me to win me over after I spoke to my husband before I ended up writing that check.
That night when I got home and talked with my husband abouut what happened at Creatve Floor's showroom. He told me to put a stop payment on that check and I never should have written the check for the full amoumt - always put 50% down and give the final 50% on delivery. Being it was Easter weekend I couldn't call the bank to put a stop payment on the check until Tuesday morning. At 9:00 Tuesday morning I called the bank to put a stop payment on the check and learned he had gone to one of those check cashing centers, like Amscot, to cash the check, so there was nothing that the bank could do to get my money back since it had already been processed and now had to take him to court to sue the company.
Creative Floors does not have a license, they work under the license of another company who practice business in a similar manner. So if you want to sue them you need to sue the company with the license. I don't remember the name of the company with the license but will post it if no one else has yet.
