Poor backfilling

On 4 i signed a contract to have inground pool installed by carlton pools. It took them until 7/15/10 to start even though the contract states by law that it would be done by 7/21/10. Mid july they finally started building it. It was completed and ready to use with concrete decking by 9/3/10. At the end of sept 10' it had rained so much and on oct 1,10' we noticed that the ground underneath the concrete decking had settled so much that concrete was suspended in mid air (about 15 ft in length). It obviously shows that there was not proper tamping of the ground that was backfilled around the pool before they set the concrete decking. The dirt has settled about 8 inches in depth underneath concrete. Due to this the concrete has come away from the coping that resides on the pool itself. If dirt is not put back under concrete it will eventually collapse and cause structural damage to the pool itself. Our contract specifically states that carlton pools is responsible for 3 feet of backfiiling and grading around pool before concrete is set. I have called numerous times / numerous people and can only leave messages. They finally had someone from their company come out and take pictures. When he reviewed it with the owner - joe solano and joe solano III they decided that they were not responsible for dirt settling, even though the pool is still not passed by the township and clearly shows that they improperly backfilled and didnt tamp dirt down before setting concrete. They are now not answering our phone calls and are dismissing them. Along with this, the dirt around the filter and pump has settled where it is now leaning which will eventually cause pipes to break their seal and filter to fall over. We only owe them $250.00 more but cannot get them to finish to get a passed inspection certificate from township. Also i have made a dozen phone calls to service and construction dept. To have them fix unsafe wobbly handrails, in which they keep dismissing and not fixing.
