Ripoff poor workmanship home builder won't cover warranty

Dear Randy:

I am writing to you in yet another attempt to resolve these issues directly without involving legal and other procedures that may be available. With regards to your letter to The Attorney General's Office dated May 27, I think I now understand the problem. It seems you don't have the facts straight and I blame that on your being out of state. No matter, if you verify the facts in this letter, I think you will feel more comfortable about the situation and help me resolve them so we can get out of each others lives. I am willing to work with you on this. I have collected documentation to refer to so let us deal with them one point at a time:

1) You claim that your efforts have never satisfied me. This is simply not true! When your repairmen come, we truly have every hope and dream that the repair will finally fix our issues. We want these problems solved as much as you do. Even it were true that you have yet to satisfy me, all it take to satisfy me is do the job correctly, this is something that seems to elude some of your people. If your home was like ours, you would not be totally satisfied either. Let me list the times your people have been here:

When we moved in, we did not have electricity in three rooms. Your electrician came out and fixed this. I was happy with him.

Also, upon moving in we discovered that there was no air conditioning. Ground Source came (after two days) and it was determined that they had not completed the installation. Although they took two trips over two more days to complete the job, I was finally satisfied that it was fixed and working. Unfortunately, the air conditioner was so noisy that we could not hold a conversation while it was running. Ground Source came back and said this was normal and that they could not fix it. You sent another gentleman named Dave to fix it and he did so, very well I might add, thank you!

Matt came out to install a lamp in the entryway, and he did this just fine. Later, he was out to install a missing electric plate but he cracked it and said he would be back to fix it but never returned. He also said he would return to fit the attic ladder and repair the hole in the access door but he never did. He came out to attempt a repair of the drainage system causing flooding but was unsuccessful. He attempted to patch a hole in the drywall of the kitchen but made a mess and did not come back to sand it. He also came to fix the dented front door. While doing this, he damaged the insulation on the door frame with the sander and the door now looks worse.in addition, the door has a gap between it and the floor allowing air to flow freely. Speaking of doors, the entrance door to the house from the garage is not level either, which is preventing it from closing properly. He did come out and add splash guards to the front porch area which look fine but I'm not sure it will fix the unusual amount of water that comes down in that area. He fixed the over hanging asphalt shingles in the roof valleys and did this just fine. He also attempted to fix a leak into our garage from an unusual protrusion in the porch area by sealing the hole with some kind of pinkish colored sealant. I am sorry to say it did not fix the leak and the seal looks terrible.

Daryl Miller came to our home three times; to repair two leaks on two separate occasions, and another time to check out the noisy water heater and water hammer from the pipes. I was happy with his work in repairing the leaks. He did nothing to repair the water heater or the water hammer.

NCI came out to complete the fireplace. I was happy with them. More recently, they came out to add insulation, and I was again happy with their work.
Findlay's Lawn graded the property for seeding. He left a lot of rocks in the soil. He also damaged my vehicle and our driveway with his tractor. As you know he did not complete the job. The other fellows, who came to seed the lawn, did so during a wind storm, in fact, they were complaining about the hay getting in their eyes! Needless to say, the seed and hay ended up in clumps everywhere except where it should be.

Mark Funello came out to see the cracks in our garage. He admitted that this was his fault but offered no solution as to a repair for fear of further damage.

As you know, we have flooding into our garage from the driveway. After nobody believed me, you sent Gary Hansen out to conduct a level survey, who verified that the driveway was graded incorrectly. Mid-Ohio Cement was out to replace the affected area. They damaged the garage door frame, and made a mess. Even worse, the square that they replaced does not even come close to matching. To make matters worse, it did not fix the issue. We still have flooding into the garage. I recently had a cement expert out and it seems that the main problem is that Mid-Ohio did not allow for a lip preceding the garage floor and the water is flowing without into it with out restriction. Moreover, the driveway is literally falling apart. The expert says either Mid-Ohio overworked the cement or he used a bad mix from the supplier. I am unsure how to proceed on this one.

We had the paint guy over to show him the drywall issues. He said it seemed normal but I have others in t he business who say that it is wrong. To be honest I give up on this one. Just a note on this, the painter thought we were complaining about his paint job, but we were happy with his work, although the doors have some paint issues but he said he did not paint them (maybe this is the problem)?

Also, I still don't know who was responsible for cutting the holes in the curb to connect the drainage to the street but this was never done. We have large holes in the lawn near the sidewalk where the drainage ends from water erosion.

Again, if this were your home, surely you would not be totally satisfied either!

2) It is true that our carpet installers were unprofessional. But, I dealt with them directly on all issues that they created and I have not made any claim to you on those problems. As far as the wet carpet, I had hoped to let you inspect it but unfortunately it began to smell so rotten we could not stand it any longer. This happened on a weekend and your office was unavailable. I have pictures and witnesses of the water damage that was caused by your drywaller. Fortunately, the drywaller admitted to causing this and has provided restitution.

3) As mentioned above, you replaced a small square of the driveway in the affected area. My complaint is not about the cracking but rather about the flooding. I understand that the warranty does not cover cracking, but flooding is a major problem. Also, if you recall, we had a conference call with yourself, Scott Harvey, my wife, and I when you told us that everything would be taken care of.in fact, you said the cement would match and if it did not that the whole driveway would be replaced. I was hesitant, but that is the only reason I agreed to let you try replacing the square was under your assurance. If you need a reminder, I have a recording of that conversation.

4) Fred Rader only visited our property once and met my wife. He did not meet me. How can he say I am a nut-case if he never met me, let alone testify to it? You may want to double-check this!

5) I did not repeatedly call your sub-contractors homes at 3:00am in the morning. I inadvertently called Daryl Millers one time at 3:00am as I was told it was his office, all I wanted was to leave a voicemail for him to have in the morning. I did not call anyone on Christmas Eve as I was out of town with family! As we were never given instructions on how to turn in warranty issues, all phone calls were left to workers and contractors in an attempt to get major issues resolved. I admit to having the referred conversation with Mr. Smith but I assumed that since he was back to work that he was capable of having such a discussion. This conversation was kept to a reasonable level but once it began to escalate that I immediately made the decision to leave the premises on my own.in fact, I was so concerned about Jim that I sent another resident over to check on him. I never made any statement to anyone that I have sued another builder, in fact, I have never sued anyone. I am NOT looking for a monetary settlement; I am only looking for the new home, in new condition as it was promised to me and what I paid for. I placed the signs in my yard as an unselfish way to let others know that they should beware before purchasing a home in Park Place. I felt morally compelled to do so. If someone had warned me, I would not be in this position. Most of my neighbors have similar issues, and are not upset with me; rather, they elected me as their President of the Park Place Homeowners Association. I can provide you with a list of their names and issues if needed but I believe you already have this.

Once you receive this letter, please call me so we can discuss what options are available to me on how to get these issues resolved. I promise not to be unreasonable.in fact, you will be happy to know I have narrowed down the list to just two items, which are the leaks into our garage and the driveway causing the flooding.

Everything else, I have dealt with or I am going to forget them altogether. If you will assist me in getting the garage and driveway corrected, I will sign a release that I will not disturb you any more. Please call me anytime at 419-565-1021.
