I entered into a contract with Michael Favin with regard to the possible purchase of a condo he owned in Indianapolis, IN. This contract was a lease with an option to buy and lasted for 16 months. The realtor he used, Gloria Bulger (formerly with Coldwell Banker), contacted me on Favin's behalf. The contract read that I was to pay $400 as a deposit and a portion of my rent was to go towards earnest monies that would either be paid towards the purchase, or returned to me if the sale of the property did not take place.
Ultimately, due to MANY repair matters that were never resolved and the realtor never contacting me for these issues, I chose to not purchase the property. The realtor came into the condo PRIOR to me and my family completely moving out and took pictures before we had cleaned and removed all of our property.
These pictures were sent to Favin and he has refused from 12/31/02 to today, to refund my deposit of $400 or a total of $1600 in earnest monies. Both, which are stated in several paragraphs of the contract as refundable monies.
I have reported Bulger to MIBOR and the Indiana Attorney General. To date, due to what MIBOR calls timely filing, they have dismissed the complaint, but I am in the process of appealing their decision. Favin is a shareholder in a company called The Manoff Group. This company is a UNICEF type company that gives aid and assistance to 3rd world countries. I find it difficlut to believe that a mere $2000 is hard for Favin to come up with when $2000 would feed a 3rd world community for quite a while. Favin seems to direct his attention to everyone outside of the country, but will not handle his business here in the U.S.in a proper manner. All I ask is that I be treated with the same respect that he treats his clients. I would like my deposit returned and the earnest monies that I have invested for 16 months into this dump of a condo returned to me.
Dealing with what has come to be slumlordish mentality has truly spoiled my ideas of being a homeowner. It is a shame that people like him and his realtor, who was supposed to be keeping the earnest monies in a trust, feel it necessary to do bad business and defraud unsuspecting honest people. Favin has failed to communicate with me since 1/03, and Bulger has failed to communicate with me since 12/03. All I ask is that my money be returned to me. That is what it will take to make me go away. I will notify all that need to be notified that doing business with Michael Favin or Gloria Bulger is a HUGE MISTAKE! Bulger has numerous complaints that have been filed on her and her deceased husband for unethical real estate practices, but she is still swindling folks. Something should be done to stop this sort of unethical, deceitful acts by these two and others like them.
