Lubbock Texas order cancelled in writing, wanted a 25% restocking fee, even order not shipped

Purchased a chair on Jan 17. At the local Ashley store in Lubbock Tx. Paid by ck. (my mistake) Was told by salesman it was in stock. They would call and set up a delivery date, which never happened. I went in on the 22nd of Jan. And verbally cancelled the chair with the Manager on duty. He stated he can not change the policy of a 25% restocking fee.

I found this to be not creditable. I should talk with the VP who would be in the store the next day. I returned and of course the VP was not in and would not be in. At that time I presented written cancellation of the order. This was presented to the on duty manager. His badge said SALES MANAGER. He stated he would take care of the written cancellation.

Thurs. The 29th of Jan. I recieved a call from Ashley furniture requesting delivery time of my chair. Must not have been cancelled I informed them I had cancelled the order last week. On Fri. I received a call from the Manger who I had my first conversation with on 22 Jan. He Stated" there would be a 25% restocking fee. I told him I had not only told him but also had put in writing that I did not want the item.

I asked him for the name of the owner, so we could resolve this problem in a cordial manner. He refused to provide it. He also said he would try and find my written letter, and call me back. Of course he has not done so.
