Could not provide homes, Refused to refund deposit, products/services not as advertised

After not being able to produce plans for two homes that we had on deposit, and delaying any of our attempts to get the finished plans, Hoopa never finished the home plans. We are a dealer, and our clients who had depended on Hoopa to build their homes ended up having major problems with their loans and the payments on land that they had already purchased but had no home to build.

On another home, they have held a deposit for more than three years without doing anything. They refused to refund the deposit that we made with them even though our company fully refunded our client's deposit. After over 3 years, they still refuse to return our calls our our company's money, and they don't even give an excuse. They just say they are going to "look at the file" and never return the call.

Do you want to know the biggest rip off of all? Hoopa modular knows and does business like they can't be sued, because they CAN'T BE SUED! Because Hoopa is owned by the Hoopa Indian tribe, they can do anything they want with your money and you can't do anything about it.

It is not possible to bring legal action against them in the case that they do not deliver the product that you ordered, or if they simply decide to abscond with your money. If they build you a house that literally falls apart the day it arrives on-site, you can not bring any legal action against them.

Consider this - would you enter into any contract where the other party could take all of your money and give you nothing, and then you had no right to take legal action to recover that money? This would not be wise in any business arena, and certainly not when you are a builder trying to buy homes and sell them for profit. If you are a homeowner, it is the same problem. Your builder could give them your money to build a home, but then if Hoopa goes out of business or if they simply on a whim decide not to build you anything nor refund your money, then your builder can not do anything about it. Unless you feel 100% confident that you can recover the money out of whoever the builder/dealer is, do not buy a home from them if the supplier is Hoopa Modulur / Xontah Builders.
