We are writing you in regard to the ongoing nightmare we are having with our home builder Ryan Homes. Ryan Homes is one of the larger building companies and is listed under NASDAQ as NVR. Ryan Homes once had a reputation for building quality homes. Today that is no longer the case as you will find after reading this letter.

Poor plumbing floods house, majority of house gutted. Water shown leaking from the inside to out.

We purchased our house new in September. The house has gone through major reconstruction due to poor workmanship and code violations on many occasions. There have been three floods from broken or loose pipes, bathrooms gutted 2 to three times due to code violations and major mold remediation. During the mold remediation we had to be out of out house for six weeks.in addition we also have a bad well that has gone through numerous modifications including redevelopment and still does not pass code.

In addition Ryan's production manager (Greg Duriez) does not appear to be well informed on building codes and has made erroneous statements on numerous occasions. Mr. Duriez had made the statement it is normal to have sand in your well water and it is not a violation when in fact it is a code violation. Ryan's only defense is to blame their subcontractors.

We found it in our best behalf to hire an attorney. Once our attorney was involved Ryan Homes appeared to be willing to correct their mistakes and code violations. Up to a point they were even paying our attorney fees. We found it odd for Ryan Homes to pay for someone to sue them. A meeting was held in which we and our attorney met with three Ryan representatives and their mold expert to determine a course of action to remediate the code violations and mold issues. At that time an acceptable plan of action and schedule was agreed upon.

Unfortunately due to the poor workmanship and on going code violations many jobs had to be reworked. Our master bedroom shower was gutted 4 times in this process. Due to the extended work performed the scheduled completion time took more than twice as long. One code violation we found was that Ryan was installing materials not to manufacturers' recommendations. They were placing drywall between two impervious barriers (between a vapor barrier and bathroom tiles). Any moisture caught in between these barriers would be trapped and would lead to serious mold issues (which in fact it did).

We have serious problems with our well. There is a high level of sand in our water. We feel it when we brush our teeth and we see it in the bathtub and washer and dryer. We do not drink this well water we must buy bottled water for cooking and drinking. We made Ryan aware of the water quality early after we moved in. As mentioned earlier the production manager (Greg Duriez) made the statement it is normal to have sand in your well water and it is not a violation. Ryan has taken no serious action until our attorney was involved.

In Ryan's first attempt at correction they had their well driller subcontractor (Tiger Well) install a backwash neutralizer. This was installed without the proper permits by the well driller (a plumber was required). Just after installation there was a flood in the basement as an outcome of poor plumbing workmanship. We found out later that Ryan submitted a request for a building permit in which they stated they had a licensed plumber but in fact they did not. The Jackson township code officials fined Ryan for submitting misleading information on their permit request. Unfortunately the backwash neutralizer did not remove the sand.

Tiger Well in at a second attempt to correct the well tried re-development. This is where the submersed pump is removed and the well reworked. Shortly after we noticed a strong chlorine smell for about a month and the sand was still present.

At a later date a second flood occurred from the backwash neutralizer. This time a licensed plumber identified that incorrect pipe/tubing was used in the previous installations.

Five homes in our development (one of which is ours) have been documented by the Ocean County Board of Health (Fred McGee) as having well violations (in regard to sand) sent to the well driller. The main reason for the poor water quality is believed to be the depth at which the wells are drilled. The wells in our development are down to only the minimum depth of 60 feet. All of the well drillers we have researched all agree that this is too shallow in our area.

Currently Ryan's plan is to add a sand screen to our well while their plan for our neighbor three doors down is to drill them a deeper well down 400 feet. We find this to be unacceptable for our case.

In closing I would like to state that we have a well documented history (with many pictures and correspondence) that details the issues discussed in this letter and many others with Ryan's poor workmanship and customer service. We have written on numerous occasions to Ryan Homes corporate customer service (Ms. Merna Prins) in Virginia with out any satisfaction. Can you please help us and expose this builder.
