Dishonest Ohio Contracte

Compliant Concerning Yoho building & Remolding, LTD.

Yoho was hired for the following items:

1. Extend the garage
2. Siding on the house.
3. Deck on the back of the house
4. Fascia sophet
5. Font porch w / roof
6. Gutters
7. New Doors (Front and Back)

Total of contract was $22,000, $2,000 dollars upon signing the contract. Schedule to start mid September, did not start until late September early October of Finished early November

List of complaints

1. Poor workmanship
2. Poor work ethic
3. Poor or non existent Customer Service
4. Failure to honor verbal year warranty

Reasons for complaints
Poor Workmanship

1. Siding is falling off the house due to improper installation. Our house was built back in the 60s, they used what you would call a fiberboard it is black. On September 24. Our neighbors notice that our siding was falling off the house, this was not just on piece it was at least three sections of the siding peeling off the house and working its up the peak of the house. I investigated the reason why, the siding and j-channel was not put up properly. What Yoho had done, he had not nailed into a stud or truss, Mr. Yoho had just nailed into the fiberboard. Fiberboard will not hold a nail for long.

2. Gutter on the front porch Water seems to go behind the gutter and down the fascia board. Yoho had been out 3x to fix this he seems that he just cannot fix this item. First time he tried to fix it, he just through more nails in the gutter to draw it tight to the fascia, I tried to tell Mr. Yoho that, that was not going to work. He insisted that it would.

3. Deck Decking boards where warping, and some are splitting on ends and through out the boards. This is due to ill placement of screws and not drilling pilot holes in the decking board.

4. Back door cannot lock with a dead bolt after 10 months of use. (I tried to adjust the door be the hinges could not due to the screws would not turn)

Poor Work Ethic.

1. His starting time was usually ranged from 8 to 10 am, sometimes not until late morning or early afternoon.

2. A few nice days, and afternoons Yoho never showed up, later to find out, he had went golfing. (Why do I know this, Mr. Yoho had told me that himself.)

3. It seemed that the young men that Yoho was teaching how to do things, was doing most of the work and he would not be at the job site. These I known, do to driving by to check out if work was being done or if he was even at the house. (I only work five to ten minutes from my home, depending on traffic.)

4. When he needed his second draw of money, the bank would not give it to him, due to he had not fulfilled the contract to receive the second draw. Yoho and I had a conversation about this; he had stated to me, that he could just throw the roof on the garage extension to get it done so that he could he his money. He had run out of money on this project. My wife and I convinced the bank to give him his second draw, due to the fact that he is finally working and was on a roll. We simply did not want him to stop. (You know maybe if Yoho would not of went golfing on the nice days, he would have been farther along on the project.

5. Towards the end of the project, Yoho kept making statements that he is over budget and that he is over on time allotment on this project, that he is essentially working for free. (Again if he would of spent more time on the job site and would not golf, this may have not happened.)

Non-Existent Customer Service.

1. Every time you would talk to Yoho he was very Argumentative and always had an excuse for something. Nothing was his fault. He would also be confrontational and try to intimidate you.

2. Called Mr. Yoho on the gutter problem. Yoho seemed to be angry that he was even called on this issue. Had him out 3x for this item, still not fixed. The first time he tried to fix the gutter, he just put more nails in the gutter, to draw it tighter to the fascia. Yoho and I argued about that. Sure enough this did not work, we still have this problem today.

3. When you would try to explain something to Yoho, he would always interrupt you and not let you finish your sentence. It now seems to me that Yoho has to defend his workmanship all the time, not just with me, but also with others. (Ex: Back door situation, I tried to explain to Yoho what I had down, I was only able to get three to four words out of my mouth, he had interrupted me. I was going to tell Mr. Yoho that I could not adjust the door due to the screws would not budge.)

4. When we call and leave a message to have an item fixed, we would not get a call back. The only time my wife would get an answer was when we would call and luckily get his wife, but even then he would not come out when he said he was going to.

5. My wife was to the point that she was afraid to call, and I did want to call due to his confrontational and arrogant, argumentative manner.

6. September 24 the siding was falling off the house. My wife called Yoho had to leave a message again. Since I did not know when he would show up, I went ahead got on a ladder and popped the siding back into place, if I would not have done this, I would of lost all the siding on that side of the house. A couple hours later Yoho drives by the house and does not stop, that and I myself called his home left a message asking why he did not stop I need to talk to him about this problem. This was around 7 pm in the evening. Yoho did not call me until 10 pm. He also hung up on me, then 20 minutes later calls me back. We set up a time of 7 am the next morning.

7. September 25: Yoho was 20 minutes late for his appointment to look at the siding. He looked at the siding, even then he seemed too angry that he was at my house, and excuse never stopped. Yoho looked at the problem, told me what the problem was, which was the j-channel is coming off, which I had suggested that during our phone conversation, the evening he just drove by the house. Yoho told both my wife and I that he would be back later that day to fix this problem, and that he could not fix it at that moment.

The day went by no Yoho, So at 7:10 am the next day I called Yoho, I guess I had woke him up. He was angry with that, I am sorry but normal contracts are up and gone by 7 am, especially on a nice day, which this was. Of course during our phone conversation he had given me all kinds of excuses why he did not fix the problem yesterday and that, and was not sure that he would be able get out to fix it today. My wife called his wife to find out when he was coming over the fix the problem. Megan Yoho had stated to my wife that he was on his way. This was around 9 am, my wife called me at work; I left work so that I could be there to make sure he fixed all the items.

Well 45 minutes went by now Yoho, I decided to then check to see if he had not fixed it before an arrived home. I get on ladder to check the workmanship, I find a finish nail in the siding, and it was the same kind of nail that he used on the aluminum fascia cover. I immediately call Mr. Yoho on his cell; he states that he is on his way after he picks up his guys. That we need to talk pal. I thought to myself that what do we have to talk about; he needs to fix these items. I then called my wife to come home, because I did not want to be there at the house when Yoho arrived, due to his convertational and argumentative nature. It was another 45 min. Before Yoho arrives at the house. This is around 11 am.

He shows up in his typical, angry and convertational and having an excuse for everything mode. This time he was angry about being called at 7am in the morning and had 3 phone calls concerning this matter. Due to Yoho past experience in dealing with him, I feel I was not out of line, but an apologized to him anyway. Mr. Yoho looked the situation over again, and gave me the excuse why the siding was falling off.

My stance on these excuses is that I did not hire Yoho to give me excuses on why my siding is falling off; I hired him to put it on. If there was nothing to nail to, put something up there that you can nail too. For instance go up in the attic and put some more studs up, something to nail to. Yoho and I argued about a lot of things that morning. But all those houses are built the same in our neighborhood, and no elses siding is coming off. Why is that, this is due to poor workmanship.

In our argument Yoho had personally attacked me verbally about not getting along with my neighbors. Yes at one time I did not get along with two of my neighbors. Due to the fact they had extend their drive and pitched to drain water on too my property. And the person that Yoho is talking to is the brother in-law of this neighbor that so happens to live across the street. Yoho failed to find out that I get along with every body else around me. Plus what does that have to do with fixing my siding, back door and gutter etc?

8. During our argument Yoho stated see you in court pal, and refused to fix the problems. (I believe Yoho had no intention of fixing these items, to begin with, due to the fact that it is going to take time to fix these items. Both times he came he got out of his truck with out pulling out a single tool.)

Failure to Honor verbal warranty.

1. The refusal of fixing the following items. A) Siding, B) Back door, C) Gutter

Solution:

1. Would like the total amount of the job reimbursed back to me $22,000.00. Due to poor Workmanship, were not done properly installed.

2. If that is not possible the cost of the siding job, back door and gutter. Since Yoho seems to think that there is no way for the siding to stay on the house. I did not pay to have siding to be put on the house to only last a year. Can seem to get the gutter fixed and the due to the back door not lining up with the deadbolt lock, he feels that by me tiring to adjust to door properly, which I could not get the screws to budge, therefore nothing happen, this would be why the door is not working properly. This amount would be close to $8,000.00. To $10,000.00
