Ruined our credit report and our tennant tracker records from a huge lie

We rented a house from Westmart Realtors in October. We had several problems with Westmark! First, it took them a year to fix a couple of things that were wrong with the rent house. When they did finally take care of the problems with the house, they didn't inform us that people were coming over to fix the things, strangers just showed up unexpectedly and I was at home alone with a newborn. It's pretty scare to be in your kitchen fixing your newborn a bottle and look up out the kitchen window and see a man walking in your backyard. Or to be woken up early in the morning by loud Tejano music and banging because they finally sent people over to repair previous damage to the roof, that we were told was going to be taken care of a year before.

In about April or May of part of the back fence blew down during a thunderstorm with alot of high winds one night. I reported this to Lisa Miller with Westmark Realtors, the lady that we were renting the house from at the time. She did nothing about the back fence.in about June or July of when I was at home alone again with our son, who was less than 1 year old at the time, I rocked him to sleep and I put him in his crib. It was warm and we had our bedroom windows open instead of running the air conditioner so much. After I put our son in his crib, I walked out of his room and into the hallway. Then I heard voices. So I walked to our bedroom because that is where the voices were coming from. I saw a couple of teenagers, a boy and a girl, in our backyard. It looked like they were making out a little bit. But they left before I could even call my husband about it. Naturally he raced home and was extremely upset about it. When I reported this to Lisa Miller, she threatened to evict us. Thankfully she no longer works for Westmark, as far as I can tell.

Concerned for the safety of our young child and to reduce the stress and frustration that we had from dealing with Lisa Miller and Westmark Realtors, we chose to move back into an apartment complex. Our application was approved and we moved around October. My husband really didn't want to move and it took us awhile to agree on which apartment complex to move into. After living there for 2 1/2 years, we moved into a different rent house with a different local realtor. They also approved our application and we are currently living in this rent house. When looking into buying a house earlier this year, we were told that Lisa Miller and Westmark had put a debt on our credit report. At the time we were told not to worry about it because it was an old debt and we were told to take care of more recent things on our credit report. So that is what we have been trying to do.

My husband had to change jobs and now he's making less. And he's also working nights. So we want to move into an apartment complex for a couple of years to cut back on expenses, mainly rent and utilities. And we would feel safer in an apartment complex because they all have security officers that live on the property and we would like to move into an upstairs apartment. We have not been approved by several apartment complexes because of this lie on our credit report and it's also on our records with tennant tracker. Tennant tracker is who the apartment complexes here use to decide whether or not to rent to someone.

After the first apartment complex did not approve our application, I contacted tennant tracker to find out why Westmark had put the debt that is a lie on our credit report. We assumed that it was because of the back fence. I had recorded the fence when it was down. I recorded it on an old black and white video camera, but it was something. I expected them to try to lie about that. What we didn't expect was for Westmark to lie about structural damage to the house and make us pay for it.

During the 2 years that we lived at this rent house, there was a huge tree in the front yard, right in front of the front porch. The roots from the tree grew up under the porch and under the house. The front porch wasn't flat and even because of this. It was pushed upwards and it was cracked. When it rained, the water would collect on the porch and then seep under the house and get the carpet in the dining room wet as well as the wall that was in between the dining room and the living room and it would get the carpet in the living room right beside the wall wet too. So of course, with time, the carpet started to mold and stink. We didn't report this because it was structural damage and we didn't think that there was anything that they could do or would do about this problem. But apparently after we moved out, they decided to replace the carpet in the dining room and the living room and they decided to claim that the water damage was from the 2 cats that we had at the time. They lied, saying that our cats used the bathroom all over the carpet in both the dining room and the living room. So they put the cost of the new carpet on our credit report and they reported us to tennant tracker. And now we can't get approved to move into an apartment complex again because this is on our records.
