Sales Contract did not hold up in Court

I purchased a new home through Keller Williams. Agent was kind and polite. The builder signed the Keller Williams forms for special stipulations and punch list and promised to do the work.

Keller Williams did NOT advised me to hold money back at closing to insure that special stipulations and punch list were complete. There were even some things the county building inspector did not catch during construction, but signed off on them as having been approved.

After closing and transfer of the deed, the builder hired unprofessional individuals (from a jail work-release program) to hack at fixing SOME of the items on the punch list, and of course unsatisfactorally too!

Builder got upset with me when I insisted that 120 day was too long to keep waiting (and having to be home to open the door, etc), and that he had 14 days more to complete or I was taking him to court. He then advised me that he had talked with his attorney and the attorney told me I could go to hell, that he did not have to provide the builders warranty, the "2-10 Year" warranty, nor ever do anything else.

I tookd the builder to court, and had the real estate agent, some of the workers, professional repair people on my side. The judge ruled that "the Doctorine of Merger" is an acceptable defense - which means, per the Walton County Judge "the Doctorine of Merger allows that since the deed was in-fact transfered, that I accepted the home as is and that the builder was no longer liable for anything".

I would like an attorney to contact me concerning this. Since Keller Williams did not provide me a contract which would hold up in court, I think they are now liable for the building code violations, remainder of the special stipulations and the punch list items.
