Ripoff dishonest theft senior-fraud

Please help!!!

The beginning of April we, as a family, researched and decided to have a Premier Bathroom installed for my 89-year-old Great-Great Aunt.
Premier Bathrooms USA, Inc. Claimed that this revolutionary tub would make bathing easier and safer for her. The total cost was an overwhelming $13,100.00 - but we believed that this would much improve her quality of life. On April 7, we signed the agreement for
instillation of the tub and paid $1,000.00 in deposit.instillation was to occur no later than April 16. After several calls to see when the instillation would begin, finally Premier Bathrooms USA, Inc. Came
on April 27. At that time, we paid the remaining $12,100.00
balance - CASH. The tub was installed. We noticed several problems with the instillation and notified the Premier Bathrooms USA, Inc.
Regional Manager Trent Matthews - with no response. Then early in the morning on May 11, I heard dripping coming from my 5-year-old daughters ceiling (located in the basement under the tub) - we were able to conclude that there was a leak of some sort in the Premier Bathrooms USA, Inc. Tub. I emailed Premier Bathrooms USA, Inc. With photos of the beginning damage and at that point requested them to remove the tub.
Several more phone calls later and finally their contractor Preston Parker of Parker Builders here in Colorado (the Premier Bathrooms USA, Inc. Contractor that originally installed our tub) came out to look at
the tub - he filled it up looked things over and decided that there was not a problem with the tub or his instillation. Now I must tell you - they had to move the plumbing from the south side of the bath to the north side of the bath to accommodate the tub. Not 15 minutes after he left, water started dripping from the ceiling in my daughter's room again. Again, I called and emailed with requests to remove the Premier Bathrooms USA, Inc. Tub. We want the tub out and a portion of our money
refunded. I have even contacted the office in Kent WA and was assured someone would resolve this situation ASAP.
My Great-Great Aunt is almost 90 years old - she has not been able to take a shower in weeks - we just want to give her a great quality of life for her last few years
here - she should not have to sponge bathe when she could be showering - especially after spending $13,100.00 (That is a very expensive sponge bath!).

I was then told to contact an Allan White - the Premier Bathrooms USA, Inc.installation Manager. After a call to him - we waited a few more days - still with no resolution - I continued calling him with no return
call. I finally reached a Catherine who said she would forward my concerns to someone else. I then found the number to the corporate office in Florida. I called and asked for the President of the company - but was told he was out of town and was referred to the Vice President
Michael Light. While waiting for him to call - I then finally received a call from A Dave Harmon located out of the Canada Premier Bathrooms USA, Inc. Office saying his legal department said Premier Bathrooms USA, Inc. Is not responsible for the tub problem.

HERE ARE THE BASIC FACTS
- the plumbing to the original tub was moved - the Premier Bathrooms USA, Inc. Tub was installed and now our ceiling is leaking
- we can not use the tub, there is damage to our ceiling and we just want the tub removed. Since we stopped using the tub there have been no leaks - only when water is put into the tub or that tub drained do we get the leaking in the ceiling.
Friday June 16 Preston Parker of Parker Builders came out to the house and was able to confirm
that there was dripping in the ceiling in my daughter's room and the sub-floor (under the Premier Bathrooms USA, Inc. Bathtub) was wet. He called another plumber out to the house to find the leak. This independent plumber confirmed that no other pipe in the house over my
daughter's room was leaking - we all agree that it has something to do with the tub, either the door seal or the lack of caulking around the tub. While looking through our paperwork, we saw the 12-month "no-quibble" guarantee on all parts and labor - and a lifetime guarantee
on door seal. With all of that said this $13,100.00 Premier Bathrooms USA, Inc. Bathtub we purchased from Premier Bathrooms USA, Inc. IS NOT WORKING FOR US! It has been here since April 27. From April 29,
2006 (the day we were told we could begin using the tub) - May 11 the tub was used exactly 4 times (in those 13 days) - before we noticed a problem with it leaking - and has not been used since... It is now June 20 (this means we have not had a usable tub in 40 days).

I want to point out a few other problems while we are at it. There is no caulking around the safety bar handles. There is no caulking at the top of the shower, the window was not painted and half pieces were put together on one of the window frames. Nail holes were not filled and
painted. The door frame was removed in order to install the tub - but as you can see from the photos below, we are not able to close the door - because the frame was not put in correctly. There is OBVIOUS damage
to my daughters ceiling and the Premier Bathrooms USA, Inc. Tub is obviously not level. Not to mention the water stains on the sub-floor of your Premier Bathrooms USA, Inc. Tub and obvious water damage to floors and ceilings under this tub.

I believe (after meeting with the contractor and the independent plumber) that either the door seal or the fact that the tub is so severely un-level or combinations of both are the reasons the tub is leaking through the sub-floor under your Premier Bathrooms USA, Inc. Tub to the downstairs ceiling. Our request is the same as it has been for almost 2 months, we request that Premier Bathrooms USA, Inc. REMOVE this tub immediately and REFUND our money.

I was confident that all of my evidence would convince Premier Bathrooms USA, Inc. A "family-owned" company to do the right thing. "As Premier Bathrooms USA / Canada President Phil Barnes says "Everyone has the right
to be able to bathe in comfort in their own home"" (Premier Bathroom's contract)

To compound matters, the tub is not level - I have attached photos below of not only the beginning ceiling damage, but also the un-levelness of the tub. I really believe we have faulty installation. It has now been
almost a 2-months, we are out $13,100.00 for a inadequately installed Premier Bathrooms USA, Inc. Bathtub, neither my Great-Great Aunt (now almost 90 years old), my Grandmother (72 years old) nor my Grandfather
(74 years old) are able to use the Premier Bathrooms USA, Inc. Tub/shower. This is not fair! We have a $13,100.00 unusable tub.

Please help us - we just need a refund back so we can have our house repaired and can have a different shower / tub installed. Can you help us? I don't know what else to do, I am responsible for the health and well being of my Great-Great Aunt and Grandparents and they are not able
to go in the basement to shower - and my Great-Great Aunt is so weak we can not take her to a relative's house to shower either. Please don't let Premier Bathrooms USA, Inc. Just take our $13,100.00 and run. Trust me - we didn't spend the last of my Great-Great Aunts savings for
something that doesn't work.
