Bonnie McMiIllan vs. PDQ Door Manfacturers, Inc.

How can consumers fight for their rights? I went through the court system for two years to no avail.

I'll try to make this as brief as possible.

Custom cabinetry and countertops were installed in my home in September by PDQ Door Manufacturers.
Price $13,691.07
I paid all but $1,500 because the work was finished improperly or not at all.

Here are just a few examples of the shoddy workmanship:

Lighting in the cabinets does not work. Lights have gotten hot and melted.
Legs on sink were installed upside down
molding was not installed correctly on the top of the cabinets (miters are not even), caulking is pulling away from the ceiling
finish on the cabinets was missed in numerous places (bare wood)
cabinets were not hung straight
fingerprints in the finish
panels are split on three cabinets

I have several estimates to finish this work in amounts of $5,000 and up. These figures are due to the cabinets already being installed. They would have to be taken down and new crown molding put up. The finish cannot be applied inside the house.

PDQ Doors refused to complete the job.

Just before Thanksgiving, November, PDQ Door placed a lien on my house and filed suit against me in Jackson County for nonpayment of the $1,500.

December 1, I sent $300 to an attorney in Jackson County who had the lawsuit dropped because it was filed improperly.

However, the lien was still on my house, therefore, on December 2, I retained an attorney for $2,500 and filed suit against PDQ Door.

In 2005 depositions were taken. My cost ($697.00)
We went to mediation to no avail. PDQ Door offered to remove the cabinetry and to keep my money. My cost ($400) for the mediation.

On November 8 we went before Judge Douglas Stephens with 3 witnesses. Judge Stephens did not want to hear from my witnesses because they were repetitive.

The Judge looked at my pictures of the molding and stated I would not have these cabinets in my house.

One of the defendant's witnesses who also installed the cabinets and molding stated that he would have never left a job looking like this. But, yet, these pictures do not lie.

However, the Judge ruled in the defendant's favor stating that the cabinetry added value to my house and ordered me to pay:

$1,500 lien with 12% interest.
Plus $9,614.96 for half of the defendant's't attorney fees.
And an amount, to be determined, for defendant's court cost.

Is this justice?

I am between a rock and a hard place! By the time I pay all of this money, I'll have $30,000 plus in cabinets that are not finished.

To appeal this case, it would cost me another $2,500 plus.

My attorney has filed a motion to reconsider with the Judge. However, I am told that this is highly improbable.
