I contracted with Drees Homes to build a home for me. Before signing the contract I asked about a road that backs up to the lot they were recommending. I explained to the sales person that I enjoyed spending time outside and wanted a large yard. I asked Drees for the largest lot in the subdivision and they recommended one that backed up to a four lane road that was connected on one end. I asked what the road was going to be used for and they told me that the road was for residential access. I trusted the builder and thought nothing more of the road.

After we closed on our home we received a water bill from the City with a traffic update. The traffic update indicated when the road would be completed and it alluded to some importance of this road. I became concerned and again asked Drees what was going on with the road. They said that it was only for residential access.

Later my wife found an article describing the road as a corridor. I began to research the road and found that this road will be the Lake Lewisville Corridor and after a bridge is built across the lake the estimated traffic would be 46,000 cars per day. Once again, I called the builder and explained my findings. The builder told me that the path of the Corridor did not pass near my house. I went to the City to inquire about the road and found that the Corridor would be passing through our neighborhood, and the speed limit would be 45 MPH, and all traffic would be allowed. I also found that the decision for the path was decided in 2000.

I went back to the builder and gave them the information and they said that I should have known about the road because it was labeled on my plat as Eldorado Parkway and that they would do nothing for me or their other customers. I cannot sell my home now because I would be in direct competition with the builders. I have to disclose the intent of the road to potential buyers and the road will be complete when the builders move out. I will be stuck in this home for quite some time if nothing is done for me.

The City is reporting that the builders that are building my community knew about the road and were involved with the road. The City zoned the property and contracted with the community developer to build the road. The HOA was involved in resolving issues surrounding the road.

There are two other builders in the construction area: Landstar Homes and Highland Homes. The Landstar representative is admitting she knew about the road, but does not tell anyone unless she is asked. All three of the companies either did not tell what the purpose of the road was or lied about it when questioned. There are around 120 homeowners in my area that are very concerned and feel there is nothing that can be done about the issues. It would be a very expensive and lengthy lawsuit for us and most people are willing to let everyone get away with what they did.

The builders and developer placed an amenity center on one side of this road forcing the majority of the homeowners to cross the road. 450 homeowners will have to cross the road to swim or go to the park. The other side has 300 homes. The School district is building a school on the other side that we will not be able to get to safely.

The builders are saying that this whole thing is our fault (all homeowners) and are not taking any responsibility for their actions. I have been willing to compromise to find a solution, but have not been successful in my efforts. I have been working on this for over 5 months now and have a lot more information I could share.

I have asked the City and Denton county for help regarding safety and road noise. The City had refused to do anything, but is now asking the county for help. Denton County has offered to help. Denton County is performing studies to see if they can install traffic lights, reduce speed limits, and place a school crossing on the road. They have promised to look into modifying the screening wall to make it more effective in reducing noise and to fund planting of landscaping along the road. Even if Denton County can do all of these things, I will be on a very noisy road and wish to move away from it. Had Drees informed me as they should, I would not have purchased my home.

Please call Drees and ask them to refund my money and make it right for me. Thank you.
