My fiance and I applied at Summer Oaks Apartments for a 2 bedroom rental and with the 90.00 application fee, we also had to pay 75.00 deposit on the last 2 bedroom available. I was told 5 days later that we were denied the apartment because I had an eviction from a previous apartment community. I had no idea that this was on my record, so I requested my credit report from the agency they used and contacted my previous apartment complex that week. The eviction was over 4 years ago and since I had never applied for an apartment since then, I didn't know that I even had an eviction on my record.
Summer Oaks cashed the 90.00 check immediately, and then 3 weeks later, the 75.00 deposit fee. I was told since I lied on my application, they are entitled to my deposit. This seems very unethical to me. An apartment community is not supposed to make profits on applications. Shame on LBK Management Company for doing this and stating they don't have to prove anything to take money that isn't theirs.
