Bad recovery disk

I have An HP dv9500 notebook, the first time in four years its time to reformat, when I tryed to use the recovery partition I get error#0x40010013000001002,
So I think lucky me I bought a recovery disk when I bought the computer, and I get 2 hours into recovery when it stops with the message Recovery Has Failed details or retry. I now read that the disks are Bad and hp knew it. I'm paying for the new disk shiping. And thats it for HP and me.
