Cannot return a Surface - Microsoft Surface

I called Microsoft Store when first seeing the Surface advertised - thought it would be a nice Christmas gift - called them to find out how to pre-order so could make sure I would get it in time - while on phone told them it was to be for Christmas. Then went on line to do actual order - ordered the Surface 64 with extra protection for $850.00 - also on order form specified it was a Christmas gift and added note to recipient. Received it in late October. Put it away for Christmas - did not open or use. At Christmas the recipient opened it and found it would not accept the apps he needed so wanted to return it. I called Microsoft on 12/27 and was told I only had 30 days from date of sale to return it. They told me I should have seen their note at bottom of order form to check out and read their return policy that was printed out on a different page. I never even noticed the notation nor thought to check on return policy as I have, for many years, ordered things from Amazon, JCP, QVC, etc. Early for Christmas and as long as I was honest with them and specified the items were for Christmas, had an honest excuse for a return, didn't try to cheat anyone, returned item in good condition, I have NEVER, EVER had a problem with a return - it just never entered my mind to question it. So now I am out the money, I can't afford to purchase a different laptop, and the recipient is out a gift. This is just plain BAD BUSINESS.
