Below is a word for word copy of my Ebay online complaint reporting form that lays out both sides of the story. Ebay is not interested in helping out, they made it clear they are not interested in policeing thier buyers/sellers. My recent inquerries to Timewheels about a refund have been met with threats of a Libel suit, this guy is really slippery and seems like he has plenty of experience with bullying people with threats of non-shipment or Libel suits for anyone that should dare leave him any negative feedback, this all started because he could not answer one simple question, a ship date? His replys included anything but a date. The lessons I have learned from dealing with Timewheels, NEVER pay by check and NEVER have undocumented conversations (phone), he insisted we talk on the phone when things started to go wrong, now I understand why.
(my statement)- Seller was paid in full within 7 days of auction close, check cleared 5-13-04, he has made it clear he has no plans to send items. I no longer have need for the items he owes me, his delay has caused me to buy elsewhere, I would prefer my money back at this point. I have the canceled check as proof if needed, as well as my email attempts to get a ship date. Three weeks after the auction I started asking seller when I could expect a tracking number, he got me on the phone to let me know he would ship only after I left positive feedback, and threatened if I left neg he wouldn't ship for months or maybe not at all. I left a neg and commented on his threat, he has obviously made good on it.
(Timewheels statement)-Buyer did send check as payment, but had a zero feedback. Before he sent payment I notified him of a 12 day hold on these funds, after 3 days he complained and told several lies. He couldn't wait the twelve days and despite my warnings he would be charged for ANY unfair action (not his claim/lie-see feedback) he decided to post a vicious lie. Now he owes me another $1000. Since he is costing me every day with his untrue comment and poor business sense. I have all the proof in emails.
(my statement)-Thats obsurd, the first inquerry about a ship date was on the 15th (13 days after auction) after I saw my check had cleared. The only warning given was as stated; I would not get my part if I left negative feedback, if Timewheels has a different version of his "warnings", I wish he'd expand on his above statement. Where in the Ebay buyer/seller contract does it state that members are liable for lost business as a result of leaving negative feedback. Bottom line is that Timewheels IS a non-performing seller, his above statements comfirms that the reason he has not shipped is because of the negative feedback I left, I don't consider negative feedback "unfare action", and there is nothing in the buyer/seller contract that makes it acceptable for seller to not ship items if they recieve such feedback, the proof is in Timewheels actions.
(Timewheels statement)-Learn to spell and LEARN TO TELL THE TRUTH-LIAR. The postmark was 6 days after the auction so how could you expect my hold on the check to start before I got it (about 12 days after the auction) moron? I already explained this, that is why You are a liar and a moron.
